The position of Borough Administrator of the Borough of Closter is hereby created, and the employment of a qualified person for that position is hereby authorized.
The Borough Administrator shall qualify, be appointed and serve a term of office in accordance herewith.
A. 
The Borough Administrator shall be appointed pursuant to the provisions of N.J.S.A. 40A:9-136 and need not be a resident of the Borough.
B. 
The term of the Borough Administrator appointed after the adoption of this chapter shall be at the pleasure of the governing body.
C. 
Suspension and removal.
(1) 
The Borough Administrator may be suspended without pay by the Council at any time pending a hearing. He or she may be removed from office by the Council for just cause, upon 30 days' written notice after adoption of a resolution setting forth the reasons for removal. Such resolution shall be adopted by a two-thirds ( 2/3) vote of the Borough Council.
(2) 
The Borough Administrator, upon receipt of a resolution of removal properly approved, may reply within 10 days of receipt and request a public hearing. A public hearing, if any, shall be held not earlier than 15 days nor later than 30 days after the request is received by the Borough Council. The findings of the hearing and decision of removal shall be by written resolution approved by a two-thirds ( 2/3) vote of the Borough Council.
(3) 
If the Borough Administrator is restored to his or her position, he or she shall be entitled to any compensation lost by reason of his or her suspension.
D. 
The Borough Administrator shall be appointed on the basis of administrative qualifications with special regard to education and training in business and government affairs and experience therein.

During any approved absence or disability of the Borough Administrator, an officer or employee of the Borough may be appointed by the Borough Council to temporarily perform the duties and responsibilities of the position.
The compensation of the Borough Administrator shall be fixed by the Borough Council in a Salary Ordinance of the Borough.[1]

The Borough Administrator shall be the chief administrative officer of the Borough of Closter under the general policy supervision of the Mayor and Council. The Administrator's duties shall include the development of rules and regulations for administrative procedures governing purchasing practices, operation of all departments, personnel management and general coordination of departments, offices, boards and agencies of the Borough, all for the purpose of increasing the effectiveness and efficiency of the Borough government and promoting its economic and responsive operation. The Administrator shall:
A. 
Supervise and direct the business activities of all Borough departments and recommend, develop, promulgate and implement, with the approval of the Mayor and Council, sound administrative, personnel and purchasing practices and procedures for all departments, offices and commissions of the Borough of Closter.
B. 
Act as a liaison among the various municipal boards, agencies and departments of the Borough of Closter and its professional advisors and be responsible for the coordination of interdepartmental operations, with the authority and duty to discuss with department chairmen and department heads such matters as may be deemed necessary to the interests of the Borough of Closter municipal government and to give direction, as may be deemed proper under the circumstances, within statutory limitations.
C. 
Annually, after consultation with the Borough Finance Committee and Chief Financial Officer, collect all necessary data and prepare a proposed capital and operating budget for consideration by the Mayor and Council. Said proposed budget shall be accompanied by the proper supplemental material in support of the proposed budget appropriation with a comparison of prior years' expenditures and an analysis of the proposed expenditures, with recommendations regarding the feasibility thereof.
D. 
Serve as the chief personnel officer of the Borough of Closter and, as such, after prior approval of the appropriate Council authorization, hire and promote employees of the Borough of Closter and, subsequent to satisfactory completion of the probationary period where applicable and, per the Personnel Policy and Procedure Manual, advance said employee or employees to the next step. When it is deemed necessary or advisable for the betterment of the Borough of Closter to suspend an employee or employees, the Administrator may, after prior approval of the Council, discharge any employee or employees. All employees covered by state statutes shall be promoted or discharged only in accordance with such statutes. Any action taken with respect to a department head shall be taken only after consultation with the Mayor and Council. The Borough Administrator shall report all actions taken under this subsection at the next regular meeting of the governing body.
E. 
Participate in the negotiation of collective bargaining contracts with agencies, organizations or associations representing Borough employees, subject to the approval of the governing body, and for the administration and enforcement of such contracts and personnel policies and practices of the Borough.
F. 
Attend all meetings of the Mayor and Council as directed by the Mayor and Council, with a right to take part in the discussions. The Administrator shall receive notice of all regular and special meetings of the Mayor and Council and all advisory committees and may attend all such meetings, whether in or outside of the Borough of Closter, as requested from time to time by the Mayor and Council.
G. 
Keep the Mayor and Council informed of all matters assigned to him/her or otherwise within his jurisdiction through periodic reports, either in writing or orally, as directed by the Mayor and Council.
H. 
Report to the Mayor and Council annually, at such time as the Mayor and Council may require, on the coverage, expiration date and premium of each surety bond and contract of insurance, the nature and terms of outstanding leases, the rent reserved by each and their respective expiration dates.
I. 
See that the provisions of all franchises, leases and concessions granted by the Borough of Closter are complied with.
J. 
Oversee the letting of contracts and supervise the performance and faithful execution of the same, except insofar as such duties are expressly imposed upon some other Borough of Closter officer or official by statute.
K. 
Keep the Mayor and Council currently informed as to federal aid projects and state aid projects and any other aid programs for which the Borough of Closter may qualify.
L. 
Act as liaison between the Borough of Closter and the various county, state and federal agencies with respect to all applications for funds and/or services needed or required by the Borough of Closter.
M. 
Research, apply for and supervise the implementation of funding grants from various sources for the improvement and development of the Borough's capital projects and for services to the Borough and its residents.
N. 
Perform such other administrative and ministerial duties and functions as may be assigned by the Mayor and Council.
Nothing herein shall derogate from or authorize the Borough Administrator to exercise the powers and duties of elected officials of the Borough and of the boards and agencies thereof established pursuant to law.
