As used in this chapter, the following terms shall have the meanings indicated:
BRAKE RETARDER
Any mechanical device which is designed to supplement a vehicle's service brakes by producing a retarding torque about one of the rotating components in a vehicle, converting kinetic energy to heat and thereby retarding the forward motion of a vehicle.
MOTOR VEHICLE
Any vehicle which is self-propelled except an electric personal assistive mobility device or a vehicle which is propelled solely by human power.
PERSON
Any individual, partnership, limited liability partnership, firm, company, limited liability company, corporation, association, or any other legal entity and with respect to each, its agents, servants and employees.
No person shall use or operate a brake retarder on any motor vehicle while traveling on or along the following streets, roads, alleys, or highways within the Borough of West Conshohocken:
A. 
Front Street (SR 0023) between Bullock Avenue and Matsonford Road.
This chapter shall not apply to emergency driving situations requiring the use of a brake retarder to protect the safety and property of the residents of the Borough of West Conshohocken, other motor vehicle operators, pedestrians, and the operator and passengers of the motor vehicle involved in said emergency situation.
This chapter shall not apply to emergency motor vehicles.
The Borough shall cause to be erected upon the streets herein specified signs regarding the prohibition of the use of brake retarders clearly visible on and along Front Street (SR 0023) between Bullock Avenue and Matsonford Road pursuant to PennDOT regulations.
Any person who violates any provision of this chapter shall, upon conviction thereof before a District Justice, be sentenced to pay a penalty or fine in an amount not less than $100 and not more than $1,000, together with the cost of prosecution and attorney fees; and, in default of payment of such penalty, fine or costs, to imprisonment for a term not to exceed 30 days for each such violation. The provisions of this chapter shall be enforced in the same manner as provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Every occasion that a violation under this chapter occurs shall constitute a separate offense.
This chapter shall be enforced by the Borough of West Conshohocken Police Department.
