No person, firm or corporation shall construct any swimming
pool in the city without first obtaining a building permit from the
building director in accordance with the provisions of section 301
of the building code adopted by section 6-41.

The application for the permit required by this article shall
be in duplicate and shall contain, among other things, the location
of the proposed construction and the address or other identification
of other property over which the contractor must move materials and
equipment to gain access to the construction site.

No person, except a property owner of the premises for which
the application for the permit herein required is being made or a
person licensed by the state contractor's licensing board of a category
permitting the construction of swimming pools, shall be issued a building
permit for construction of a swimming pool.

A building permit required by this article shall not be issued
unless the applicant has obtained an encroachment permit with the
city engineer, to indemnify the city for any damage to improvements
located within the public right-of-way used by contractors in the
course of construction, The encroachment permit shall be accompanied
by a fee to be set periodically by resolution of the city council.

The indemnification required under section 6-405 may be released
upon certification by the city engineer that any city property damaged
by the contractor in constructing a swimming pool or during other
construction within a public right-of-way has been restored to as
good a condition as it was prior to such damage or upon certification
that the city property has suffered no damage incident to any construction.

The city engineer shall have the right to inspect all trucks,
tractors, excavators and other equipment proposed to be used in the
construction of swimming pools in the city. He or she shall be the
sole judge as to the hazard or danger that such equipment may impose
upon curbs, gutters, sidewalks and other improvements as may be located
in the city right-of-way at or near the construction site, and he
or she shall be vested with full authority to prescribe measures for
the protection of city improvements.

In the event of damage to any street, curb, gutter, sidewalk,
or any other public property incident to swimming pool construction
or any construction within a public right-of-way, the city engineer
shall cause such work as may be necessary to restore the improvements
to as good a condition as the improvements were prior to such damage,
and shall charge the cost thereof to the contractor to whom the permit
was issued for the particular construction job. Such work may be performed
by local contract or by city forces as deemed most economical and
appropriate by the city engineer.
