The Commission may refuse to examine, or if examined refuse
to certify as eligible after examination, any applicant who is found
to lack any of the minimum qualifications prescribed in these Rules
and Regulations for the particular position for which the applicant
has applied.
Rejected or disqualified applicants for promotion have the same rights of appeal as stated in §
21-24 of these Rules and Regulations.
The examination for the positions of Corporal, sergeant, and
Lieutenant shall include a written and oral examination which will
be graded on a 100-point scale. Only those applicants who successfully
complete the written examination will be permitted to advance to the
oral examination. If an applicant successfully completes both the
written and oral examinations, their final overall score shall be
calculated with the written examination representing 60% and the oral
examination representing 40% of the final overall score.
Veterans' preference shall not apply to promotions.
At the conclusion of the examination requirements, the Commission shall rank all passing applicants on a list with the applicant receiving the highest score at the top of the list and the applicant receiving the lowest at the bottom of the list. The eligibility list should be valid for one year from the date the Commission ranks all passing applicants and formally adopts the eligibility list. The Commission may extend the life of the eligibility list in the same manner as set forth in §
21-32. The Council may void the eligibility list at any time for any reason.
In the case of a vacancy in the office of Chief of Police or Deputy Chief of Police, or in the case where an individual holds either position but has not been previously subject to a noncompetitive examination, the Municipal Manager, with the advice and consent of Municipal Council, may nominate the person to the Commission for a noncompetitive examination. It shall then become the duty of the Commission to subject the person to a noncompetitive examination, and if the person shall be certified by the Commission as qualified following same, he/she shall then be accorded civil service status, shall be subject to the provisions of this chapter, and may only be removed, demoted, or suspended without pay from the appointed position for the reasons set forth in §
21-49 infra.
