A. 
All applicants for a promotional position, except the Chief and the Deputy Chief, shall have not received a formal written reprimand for one year prior to the deadline for submitting their name to the list of eligibles wishing to be tested for the vacant position and shall have not been suspended at any time three years prior to the deadline for submitting their name to a list. Any formal written reprimand or suspension to which the applicant has timely appealed pursuant to the grievance procedure or these Rules and Regulations shall be disregarded unless the appeal is resolved prior to creation of the eligibility list.
B. 
All applicants shall have continuous prior service with the Monroeville Police Department as follows:
(1) 
An applicant for the position of Corporal shall have at least two years' service with the department;
(2) 
An applicant for the position of Sergeant shall be a Corporal and have had at least one year of experience in that rank within this department; and
(3) 
An applicant for the position of Lieutenant shall be Sergeant and have had at least one year of experience in that rank within this department.
C. 
Neither the position of detective nor any other position for which police officers receive specialist pay shall be of the competitive class. Eligibility for such positions shall not be determined in accordance with this chapter.
The Commission may refuse to examine, or if examined refuse to certify as eligible after examination, any applicant who is found to lack any of the minimum qualifications prescribed in these Rules and Regulations for the particular position for which the applicant has applied.
Rejected or disqualified applicants for promotion have the same rights of appeal as stated in § 21-24 of these Rules and Regulations.
The examination for the positions of Corporal, sergeant, and Lieutenant shall include a written and oral examination which will be graded on a 100-point scale. Only those applicants who successfully complete the written examination will be permitted to advance to the oral examination. If an applicant successfully completes both the written and oral examinations, their final overall score shall be calculated with the written examination representing 60% and the oral examination representing 40% of the final overall score.

The written examination shall be graded on a 100-point scale, and an applicant must score 70% or higher in order to continue in the application process. Applicants scoring less than 70% shall be rejected. Within 30 days after the administration of the written examination, all applicants shall be given written notice of their test results and passing applicants shall be scheduled for an oral examination appointment.
B. 
Every applicant who scored 70% or higher on the written examination shall be given an oral examination which will be graded on a 100-point scale with a score of 80% or higher necessary for passing. Applicants scoring less than 80% shall be rejected. The oral examination shall involve questioning applicants on situations relevant to the promotional position to which they applied. The oral examination shall be administered by an Oral Board comprised of active or retired members of the Pennsylvania State Police or local municipal Police Departments who were previously, or are currently, ranked at least one level of supervision above the position to which applicants are seeking to be promoted. Within 30 days after the applicants' oral examination, they shall be informed of the score on their oral examination and, if they passed both the written examination and oral examination, their final overall score.
Veterans' preference shall not apply to promotions.
At the conclusion of the examination requirements, the Commission shall rank all passing applicants on a list with the applicant receiving the highest score at the top of the list and the applicant receiving the lowest at the bottom of the list. The eligibility list should be valid for one year from the date the Commission ranks all passing applicants and formally adopts the eligibility list. The Commission may extend the life of the eligibility list in the same manner as set forth in § 21-32. The Council may void the eligibility list at any time for any reason.
A. 
The Municipal Manager will determine if a vacancy exists in the ranks and should be filled. The Commission shall certify the top three names will from the list of eligibles.
B. 
If three names are not available, then the Commission shall certify the name(s) remaining on the list.
C. 
The Municipal Manager shall make a conditional appointment from one of the three names certified, based solely on the merits and fitness of the candidates.
D. 
The Municipal Manager may object to one or more of the persons certified for reasons set forth in § 21-23 of these Rules and Regulations and the Municipal Manager may determine that the appointee is not qualified pursuant to § 21-38. If the candidate to whom the Manager objects or whom he/she determines is not qualified under § 21-38 fails to timely exercise the rights of appeal under § 21-24, or if the Commission declines to uphold the appeal, the Commission shall strike the name of the candidate from the eligibility list and certify the next highest name for inclusion on the list of three candidates for each name stricken off.
In the case of a vacancy in the office of Chief of Police or Deputy Chief of Police, or in the case where an individual holds either position but has not been previously subject to a noncompetitive examination, the Municipal Manager, with the advice and consent of Municipal Council, may nominate the person to the Commission for a noncompetitive examination. It shall then become the duty of the Commission to subject the person to a noncompetitive examination, and if the person shall be certified by the Commission as qualified following same, he/she shall then be accorded civil service status, shall be subject to the provisions of this chapter, and may only be removed, demoted, or suspended without pay from the appointed position for the reasons set forth in § 21-49 infra.
