It is the purpose of this chapter to establish procedures for
the vacation of City streets.

Upon the adoption of a resolution of intention, and the conduct
of a subsequent, noticed public hearing, the City Council may adopt
a resolution vacating a City street.
The City Council shall be the sole and exclusive body authorized
to vacate or abandon City streets within the City of Encinitas, including
vacations or abandonments in conjunction with a subdivision.

By the adoption of a resolution, the City Council may summarily
vacate certain types of City streets.
Upon recordation of a certified copy of the resolution of vacation,
the vacation is complete.
A City street shall not be abandoned unless the City Council
determines that it is not useful as a non-motorized transportation
facility for use by pedestrians, bicyclists or equestrians.
