Members of the Police Department and special police assigned to traffic duty are hereby authorized to regulate traffic and parking on Township streets and alleys in accordance with the provisions of this Part or in emergencies, as public safety or convenience may require, and it shall be unlawful for any person to fail or refuse to comply with any lawful order, signal or direction of a police officer; except in case of emergency, it shall be unlawful for any person not authorized by law to direct or attempt to direct traffic.

At any time it shall be unlawful to permit any vehicle to stand in any of the following places, except where necessary to avoid conflict with other traffic or compliance with the regulations of a police officer or traffic control devices:
A. 
In any intersection.
B. 
In a crosswalk.
C. 
Upon any bridge or viaduct or in any subway or tunnel or approach thereto.
D. 
Between a safety zone and the adjacent curb or within 30 feet of a point of the curb immediately opposite the end of a safety zone.
E. 
Within 30 feet or 9.15 meters of a traffic signal, beacon or sign on the approaching side.
F. 
Within 20 feet or 6.10 meters of any intersection or crosswalk.
G. 
At any place where the standing of a vehicle will reduce the usable width of the roadway for moving traffic to less than 18 feet.
H. 
Within 15 feet or 4.57 meters of a fire hydrant.
I. 
At any place where the vehicle would block the use of a driveway.
J. 
Within 50 feet or 15.15 meters of the nearest rail of a railroad grade crossing.
K. 
Within 20 feet or 6.10 meters of the driveway entrance to any fire department station and, on the side of the street opposite the entrance to any such station, within 75 feet or 22.87 meters of such entrance when properly posted.
L. 
On any sidewalk or parkway.
M. 
Upon any of the following streets which shall be posted with appropriate signage restricting or limiting vehicles to stand or park as set forth hereinbelow:*

No vehicle shall be parked with the left side of such vehicle next to the curb, except on one-way streets, and it shall be unlawful to stand or park any vehicle in a street other than parallel with the curb and with the two right wheels of the vehicle within 12 inches of the regularly established curbline, except that, upon those streets that have been marked for angle parking, vehicles shall be parked at the angle to the curb indicated by such marks.

It shall be unlawful to park any motor vehicle on any private property without the consent of the owner of the property.

The Chief of Police or any other person authorized by the Township Board of Supervisors shall cause signs to be posted in all areas where parking is limited or prohibited indicating such limitations or prohibitions.

1. 
It is unlawful for any person to park or leave standing any vehicle in a stall or space designed for physically handicapped persons if, immediately adjacent to and visible from such stall or space, there is posted a sign known as the "international wheelchair symbol," consisting of a profile view of a stylized wheelchair with occupant in white on a blue background, unless the driver of the car is disabled.
2. 
As used in this Section, "disabled" means either having a physical condition requiring the use of a wheelchair, artificial limb, crutch, cane or walker, or having a physical disease making it difficult or impossible to walk more than 25 feet without shortness of breath or danger of impairment of health. A certificate by a person licensed to practice the healing arts in this commonwealth shall be acceptable by the Township as evidence under this Section.
3. 
The provisions of Subsection 1 herein shall apply to all off-street parking facilities owned or operated by the Township or by any privately owned or operated parking lot.

1. 
Definitions. As used in this section, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context.
DISABLED PARKING SIGN
A sign issued by Upper Macungie Township reserving parking for one vehicle space and erected at a designated and agreed-upon area for access for a disabled person. The sign shall have the international symbol for persons with disabilities, stating that the penalty for violation is set forth in the Township's Fee Schedule and amended from time to time.
ISSUING AUTHORITY
Upper Macungie Township.
OWNER
The approved applicant for a general disabled parking space or specific person (or designated vehicle) for a disabled parking space limited to that person or vehicle.
PERSON WITH A DISABILITY OR SEVERELY DISABLED VETERAN (hereinafter jointly referred to as "disabled")
A person with a disability or severely disabled veteran possessing a disabled license plate or placard (or possessing a previously issued handicapped license plate or placard).
2. 
Disabled Parking on Public Streets. The Board of Supervisors at its discretion may provide at convenient and suitable locations in any public street reserved parking spaces for disabled persons and shall designate those spaces by appropriate signs. It shall be unlawful, and a violation of this section, for any person to park in any such parking space, unless that vehicle bears or displays either: a "disabled person" or "disabled veteran" license plate, or a "disabled person" or "disabled veteran" placard; provided that all provisions, requirements, and restrictions governing parking contained in the Code of Ordinances and state statutes apply to vehicles lawfully parked in parking spaces for disabled persons.
3. 
Disabled Parking Requests.
A. 
Ability to Apply for a Disabled Parking Space.
(1) 
Any resident of Upper Macungie Township may make application to the Township for a disabled parking space only after acquiring a disabled license or placard or a disabled veteran license plate.
(2) 
Applications are to be completed in their entirety.
B. 
Disabled Parking Criteria.
(1) 
The disabled person must be eligible for, and have in their possession, a valid PD or DV license plate or placard from the Pennsylvania Department of Transportation for their vehicle.
(2) 
The driver of the vehicle is not required to be the disabled person, as long as the driver resides in the household of the disabled person-i.e., spouse, parent. A disabled sign will only be granted if the disabled individual's disability is severe enough to warrant a space.
(3) 
The street width in front of the residence must be adequate to allow parking.
(4) 
The individual cannot have an off-street parking space available. If an off-street space is available, but the home is not easily accessible from the space, the issuing authority may consider granting a space.
(5) 
The parking width in front of the property must be at least 25 feet. If this is not the case, the person requesting must obtain the signature of the person who owns the adjacent property indicating that they have no objection to the installation of the disabled parking zone.
(6) 
No temporary disabled space will be installed for less than one year.
(7) 
There shall be a fee set forth by the Board of Supervisors via ordinance or resolution for the application for residential parking, which shall be returned to the applicant if the space designation is not approved.
(8) 
The criteria set forth above is not required for restricted parking spaces allotted for the general public or for spaces located entirely on private property.
C. 
Application Procedure.
(1) 
All applications shall be delivered to the Upper Macungie Township, 8330 Schantz Road, Breinigsville, PA 18031.
(2) 
The applicant and/or disabled person must reside at the address to which the vehicle is registered.
(3) 
The vehicle must have a disabled person license plate issued by the Commonwealth of Pennsylvania. In the absence of a disabled license plate, a valid disabled placard issued by the Commonwealth of Pennsylvania may be substituted.
(4) 
The individual cannot have an off-street parking space available. If an off-street space is available, but the home is not easily accessible from the space, the Township may consider granting a space.
(5) 
Parking width in front of the property must be at least 25 feet. If this is not the case, the section titled "Notification to Neighbors," in the application, must be completed.
(6) 
The applicant must submit a copy of their driver's license and their vehicle registration when submitting an application.
(7) 
The application must be accompanied by a check or money order in the amount prescribed by the Township's Fee Schedule, payable to "Upper Macungie Township." Other appropriate payment methods may be authorized in accordance with Upper Macungie Township procurement and payment policies.
(8) 
Applicants shall be notified in writing as to the approval or denial of their application within 30 days of receipt.
(9) 
Any change in address or change in health status must be reported to Upper Macungie Township in writing within 30 days of change.
D. 
General Disabled Parking Spaces.
(1) 
Disabled parking spaces on public streets are considered for disabled public use and can be utilized by any individual with an authorized disabled placard or license plate. No disabled parking space is guaranteed for exclusive use by an applicant.
(2) 
The placard must be prominently displayed in plain sight.
(a) 
The placard, always, must be displayed in clear sight while parked in the permitted disabled parking space.
(b) 
The placard, and/or disabled license plate, shall be always clearly legible.
(c) 
Failure to prominently display the placard shall result in parking violations in accordance with Subsection 3J, Penalties, of this section.
E. 
Application Renewal.
(1) 
The applicant shall respond to the mailing which shall be issued on the annual anniversary date of the granting of the disabled space, to certify that the conditions warranting the granting of the disabled parking space still exist and that the space is still warranted. Failure to complete and return the annual recertification shall result in the discontinuance of the disabled parking space, and the space and sign shall be removed.
(2) 
Renewal applications shall be reviewed and approved by Upper Macungie Township, who will make the final determination regarding renewal of existing spaces.
(3) 
All approved applications shall be subject to annual review subject to a fee set in the Township's Fee Schedule, as amended from time to time.
(4) 
Applications for renewal, except for temporary space renewal, shall be submitted to Upper Macungie Township, between January 1 and January 31 of each calendar year. In the instance when the original application and approval is less than one year old, the applicant shall be permitted to forgo the renewal application until the following year.
(5) 
In making the final determination regarding the renewal of a previously permitted disabled space, Upper Macungie Township shall apply the criteria contained in this section.
(6) 
Once a permit is not renewed for any reason, any application by the same applicant shall be considered a new application and shall be governed by the provisions of this section.
F. 
Fees.
(1) 
All fees are established by resolution in the Township's Fee Schedule. These fees shall be for any applicant requesting a disabled parking space be placed on a public street. Any individual with a disabled placard or disabled license plate shall be permitted to park in this space.
(2) 
All fees for permanent and temporary disabled parking spaces and renewal of permanent and temporary disabled parking spaces are nonrefundable. However, if a request is denied, the applicant shall receive a full refund of their application fee.
G. 
Location of Disabled Parking Spaces.
(1) 
No more than two disabled parking spaces shall be located on any block where parking is permitted on both sides of the street. Exceptions may be granted by the issuing authority and the Board of Supervisors in certain extreme circumstances.
(2) 
No more than one disabled parking space shall be located on any block where parking is permitted on only one side of the street. Exceptions may be granted by the Township Board of Supervisors in certain extreme circumstances.
H. 
Issuing Authority. Upper Macungie Township shall maintain a log of all existing disabled parking spaces at the time of the effective date hereof. Further, Upper Macungie Township will maintain a log of all applications for disabled parking spaces for a maximum of one year.
I. 
Revocation of Permit and Removal of Sign. Upper Macungie Township reserves the right to revoke any permit or remove any sign for a disabled parking space at any time for any reason.
J. 
Penalties.
(1) 
A person owning a vehicle parked in a disabled parking designated area without a disabled plate or placard properly displayed and qualifying under this section will be subject to citation as established in Chapter 15, Part 3, § 15-310.
(2) 
It shall be unlawful for any person or owner of realty to erect a disabled parking sign upon the streets of Upper Macungie Township without first making application for a disabled parking space through Upper Macungie Township. Any violations hereunder will constitute a summary criminal offense under the laws of the Commonwealth of Pennsylvania, and each day of violation hereunder will be considered a separate offense.
(3) 
The fine and penalty for a violation of the regulations here and before designated shall be established by resolution in the Township's Fee Schedule, as updated from time to time.
K. 
Exemptions.
(1) 
Disabled veterans of any branch of the armed forces are exempt from paying any and all application and installation fees, renewal fees or penalties as set forth in this section, upon showing proof of same.
L. 
General Provisions.
(1) 
Any stipulations made at the time of application regarding the eligibility of an applicant may be updated periodically at the request of the issuing authority.
(2) 
Disabled parking spaces shall not supersede existing parking regulations, including, but not limited to, street sweeping, snow ban or snow removal regulations.
(3) 
Disabled parking signs will remain the property of Upper Macungie Township.
(4) 
The Township will take the following factors into consideration in the issuance of disabled parking signs:
(a) 
Overall availability of parking in the area wherein a sign is requested.
(b) 
The living arrangements of an individual applicant herein; for example, a disabled person living alone and responsible for his or her own transportation.
(c) 
Existing parking problems in the area wherein a sign is requested.
(5) 
The granting of a disabled parking space permit does not entitle the applicant to the exclusive use of this space. This space can be used by other disabled persons and disabled veterans.
4. 
Addition of Disabled Parking Signs and Spaces.
A. 
The Board of Supervisors of Upper Macungie Township hereby authorizes the addition of the disabled parking signs and assigned spaces, in accordance with Chapter 15, § 15-307, of the Upper Macungie Code of Ordinances at the following locations:

The fact that an automobile which is illegally parked is registered in the name of a person shall be considered prima facie proof that such person was in control of the automobile at the time of such parking.

A police officer shall have the authority to affix upon any vehicle parked in violation of any provision of this Part a traffic tag giving notice of the violation and notifying the owner and/or operator of the illegally parked vehicle that he or she shall pay the sum indicated on the violation notice at the office of the Police Department within 72 hours from the time of the notice, that such amount shall be deemed as and shall constitute the full penalty for that violation, and that, if such payment shall not be made at the office within the seventy-two-hour period, that violation shall be subject to prosecution and to the penalties prescribed in §§ 15-301 and 15-311 herein.

Any person who violates any provision of this Part shall, upon conviction, be sentenced to pay a fine of not more than $15, plus costs.
