For the purposes of this chapter, the following terms, phrases,
words and other derivations shall have the meaning given herein:
AUTHORIZED RECEPTACLE
A litter, garbage or refuse storage and collection receptacle
as required and authorized by law, as provided by the Village for
the use of the public.
GARBAGE
Putrescible animal and vegetable wastes resulting from the
handling, preparation, cooking and consumption of food.
LITTER
Garbage, refuse and rubbish and yard waste as defined herein
and all other waste material which, if thrown or deposited as herein
prohibited, tends to endanger the public health and safety and the
aesthetic value of the property in relation to the Village or causes
untidiness or disorder within the Village.
NEWSPAPER
Any newspaper of general circulation, whether the same is
paid or free or whether it is primarily designed to report the news
or as a form of commercial advertising, which is either delivered
locally or through the mail. It is intended that this definition of
"newspaper" be given a broad interpretation to cover all local, regional,
statewide or national newspapers.
PARK
A park, reservation, playground, recreation center or any
other public area in the Village owned or used by the Village and
devoted to active or passive recreation.
PERSON
Any person, firm, partnership, association, corporation,
company or organization of any kind.
PUBLIC PLACE
Any and all streets, sidewalks, boulevards, alleys or other
public ways and any and all public parks, squares, spaces, grounds
and buildings.
REFUSE
All putrescible and nonputrescible solid wastes, except body
wastes, including garbage, rubbish, ashes, street cleanings, dead
animals, abandoned automobiles and solid market and industrial wastes.
RUBBISH
Nonputrescible solid wastes consisting of both combustible
and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard,
tin cans, yard clippings, wood, glass, bedding, crockery and similar
materials.
VEHICLE
Every device in, upon or by which any person or property
is or may be transported or drawn upon a highway, including devices
used exclusively upon stationary rails or tracks.
YARD WASTE
All accumulations of grass, prunings, shrubbery cuttings,
leaves, tree limbs, and other materials accumulated as a result of
the care of lawns, shrubbery, vines and trees.

No person shall sweep into or deposit litter
in or upon any sidewalk, alley, parking lot or other public place
within the village. The public shall place any and all litter, except
domestic, commercial and industrial litter, in public receptacles
in such a manner that it may not be scattered by the elements.

No person shall sweep into or deposit in any
gutter or public place within the village the accumulation of litter
from any building or lot, from any public or private sidewalk or driveway
or from the space between the sidewalk and the curbline.

No person, while in a vehicle, shall throw or
deposit litter upon any public place or upon private property.
No person shall drive or move any truck or other
vehicle within the village unless such vehicle is so constructed or
loaded as to prevent any load, contents or litter from being blown
or discharged therefrom.

A. No person shall throw or deposit litter in any park within the Village,
except in public receptacles and in such a manner that the litter
will be prevented from being carried and scattered by the elements
upon any part of the park or other place. Where public receptacles
are not provided, all such litter shall be carried away from the park
by the person responsible for its presence and shall be properly disposed
of in authorized private receptacles.
B. The depositing of yard waste at the Department of Public Works located
at No. 100 Wood Lane shall be limited to Village residents only. The
depositing of yard waste accumulated by paid contractors on behalf
of Village residents or other third parties is strictly prohibited.
C. The depositing of the limbs in excess of six inches in diameter and
three feet in length is strictly prohibited.
Any person committing an offense against this
chapter shall, upon conviction, be subject to a fine not exceeding
$250 or imprisonment for a term not exceeding 15 days, or to both
such fine and imprisonment. The continuation of an offense against
the provisions of this chapter shall constitute, for each day the
offense is continued, a separate and distinct offense hereunder.

A. Nothing contained in this chapter shall be deemed to prohibit actions
taken pursuant to specific permission granted by the Code Enforcement
Officer nor to limit the authority of said Code Enforcement Officer
to issue specific regulations for specific purposes pursuant to the
Code of the Village of Newark.
B. This chapter shall be enforced by the Code Enforcement Officer or
.the Newark Police Department.
