As used in this chapter, the following terms shall have the meanings
indicated:
Includes any display for sale of any goods or personal effects, upon
residential or residentially zoned property in the Village of Newark.
Nothing in this chapter shall be held to apply to sales conducted by
and for the benefit of not-for-profit or religious organizations entitled
to exemption from income taxes.
Notwithstanding any other provision in the Code of the Village of Newark,
garage sales, yard sales and porch sales, and sales of similar scope and nature,
may be had upon residential or residentially zoned property in the Village
of Newark, provided that the following conditions are complied with:
A.
Nature of goods offered. Goods offered for sale shall
have been originally acquired for personal use and benefit of seller or seller's
immediate family and shall not have been acquired for resale.
B.
No more than two sales as defined above may be held upon
any residential or residentially zoned property within any year, said year
to be computed from the date of most recent sale upon the premises.
C.
A sale permitted under this chapter shall be for no more
than three consecutive calendar days and may be conducted only between the
hours of 8:00 a.m. and 9:00 p.m.
D.
The person upon whose premises any such sale shall be
conducted shall prior thereto appear at the Newark Police Department, either
personally or by agent, and make known his or her name, residence address
and telephone number and the address where and the date or dates of the proposed
sale.
The violation of any of the provisions of this chapter shall be punishable
by a maximum fine of $250 or by imprisonment for not more than 15 days, or
by both such fine and imprisonment. Each day a violation of this chapter shall
occur shall constitute a separate offense.
