There is hereby created the Traffic Authority of the Incorporated Village
of Bellerose, hereinafter referred to as the "Authority," which shall consist
of three members, to be appointed by the Mayor for terms of two years, with
the consent of the Board of Trustees.
The Traffic Authority of the Incorporated Village of Bellerose shall
exercise all powers granted to the Board of Trustees of the Incorporated Village
of Bellerose by the provisions of the Vehicle and Traffic Law of the State
of New York, with reference to the movement of traffic and the parking of
vehicles within the Incorporated Village of Bellerose, making such regulations
as it shall deem necessary and proper governing the movement of traffic and
the parking of vehicles within the confines of the Village.
Such regulation of the movement of traffic and the parking of vehicles
by the Traffic Authority of the Incorporated Village of Bellerose shall be
by resolution adopted by majority vote of the entire membership of the Traffic
Authority. Within 24 hours after its adoption by the Traffic Authority, each
such resolution shall be forwarded to the Mayor, who shall place that resolution
before the Board of Trustees at its next regularly scheduled meeting. The
Board of Trustees may, by its vote, amend the resolution and direct that it
be implemented within the confines of the Village or may direct that it be
implemented within the confines of the Village without amendment. In either
event, the regulation of traffic or parking directed by such resolution shall
take effect immediately upon the vote of the Board of Trustees. The Board
of Trustees may reject the resolution of the Traffic Authority, in which event
the regulations of traffic or parking established by the resolution shall
not take effect. If the Board of Trustees shall not act with reference to
the resolution of the Traffic Authority at the regular meeting of the Board
of Trustees to which the resolution is presented, the resolution shall remain
on the agenda of the Board of Trustees at each regular meeting thereafter
until it shall have been acted upon.
By its resolution, the Traffic Authority may designate the placement
of parking meters within the confines of the Village, may direct the placement
of traffic control signals and signs within the confines of the Village and
shall act in all matters necessary to provide for the safety and well-being
of the residents of the Incorporated Village of Bellerose, with reference
to traffic and parking.
All regulations, ordinances and local laws heretofore enacted by the
Incorporated Village of Bellerose with reference to the movement of traffic
and the parking of vehicles, including those relating to the placement of
parking meters, shall remain in full force and effect after the adoption of
this chapter, unless and until they shall be changed by the Traffic Authority
pursuant to the provisions of this chapter.
In the adoption of any resolution regulating the movement of traffic
or the parking of vehicles within the Incorporated Village of Bellerose, the
Traffic Authority shall conduct such hearings and give such notice as may
be required under the provisions of general law.
The violation of the provisions of any resolution of the Traffic Authority,
with reference to the movement of traffic or the parking of vehicles within
the confines of the Incorporated Village of Bellerose, shall be punishable
by fine or by imprisonment, not to exceed the maximum which is permitted by
the provisions of law.
