Unless the context clearly indicates the contrary, the following definitions shall apply in this chapter:
ESTABLISHMENT
Any privately owned place of business carried on for a profit or any place of amusement or entertainment to which the public is invited.
MINOR
Any person under the age of 18 years.
OFFICIAL TOWNSHIP TIME
Eastern Standard Time, except from the last Sunday in April to the last Sunday in October during which it shall be Eastern Daylight Time.
PUBLIC PLACE
Any public street, highway, road, alley, park, playground, public building or vacant lot.
REMAIN
To loiter, idle, wander, stroll, play or be in or upon.
It shall be unlawful for any minor to remain in or upon any street, public place or any establishment in Springettsbury Township between the hours of 12:00 midnight and 6:00 a.m. prevailing time; provided that this section shall not apply as outlined.
A. 
Any minor accompanied by a parent, guardian or an adult 18 years of age or over responsible for the care and custody of the person of such minor.
B. 
Any minor upon an errand or other legitimate business directed by such minor's parent or guardian.
C. 
Any minor who is engaged in lawful, gainful employment or volunteer work during the curfew hours; providing said minor carries identification and evidence, in writing, to this effect.
D. 
Any minor involved in an emergency.
E. 
Any minor attending an activity sponsored by a school, religious or civic organization, public or governmental agency or by another similar organization or entity which activity is supervised by adults and/or the minor is going to or returning from such an activity without detour or stop.
A. 
Parents and guardians. It shall be unlawful for any parent or guardian of a minor knowingly to permit any minor under the age of 18 years to remain in or upon any public place, street or any establishment between the hours specified under § 133-2 hereof, unless accompanied by a parent, guardian or any adult 18 years of age or over, responsible for the care and custody of the minor or unless such is engaged in gainful employment during the curfew hours.
B. 
Businesses and other entities. It shall be unlawful for any operator of any establishment or their agents or employees knowingly to permit any minors under the age of 18 years to remain upon the premises of said establishment during the hours restricted under § 133-2.
Any police officer who finds a minor under the age of 18 years violating the provisions of this chapter shall obtain information from such minor as to his name and address, age and name of his parent, guardian or other person having custody of the minor and shall notify said person to physically take custody of said minor. The information obtained from the minor may be used to issue a summary citation to said minor for violation of this chapter.
Any person, firm or corporation who shall violate any provision of this chapter, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, may be subject to referral to the County juvenile probation department.
