A. 
There is hereby created and established a Planning Commission to be known and designated as "Borough of Brentwood Planning Commission."
B. 
The Borough Council shall appoint seven members to serve on the Planning Commission. All members of the Commission shall serve without compensation but may be reimbursed for necessary and reasonable expenses. However, elected or appointed officers or employees of the Borough of Brentwood shall not by reason of membership thereon forfeit the right to exercise the powers, perform the duties or receive the compensations of the municipal offices held by them during such membership.
C. 
The term of each of the members of the Planning Commission shall be for four years or until his or her successor is appointed and qualified, provided that no more than two members of the Planning Commission may be reappointed or replaced during any calendar year.

D. 
The terms of each of the members first appointed under the terms of this chapter shall commence as of January 1, 1970, and all subsequent appointments or reappointments to the Planning Commission shall be effective as of January 1 of each succeeding calendar year.
E. 
All members of the Planning Commission shall be residents of the Borough of Brentwood. At least six citizen members shall be appointed to the Planning Commission, who shall not be officers or employees of the Borough of Brentwood.
F. 
The Chairman of the Planning Commission shall promptly notify, in writing, the Council of the Borough of Brentwood concerning vacancies in the Commission and such vacancy shall be filled by Council for the unexpired term thereof.
G. 
Any member of the Planning Commission once qualified and appointed may be removed from office for malfeasance, misfeasance or nonfeasance in office or for other just cause by a majority vote of the Council of the Borough of Brentwood, taken after the member has received 15 days' advance notice of the intent to take such a vote. A hearing shall be held in connection with the vote if the member shall request it, in writing. Any appointment to fill a vacancy created by removal shall be only for the unexpired term.
The Commission shall elect its own Chairman and Vice Chairman and create and fill such other offices as it may determine. Officers shall serve annual terms and may succeed themselves. The Commission may make and alter bylaws and rules and regulations to govern its procedures consistent with this chapter and any amendments thereto and the laws of the Commonwealth of Pennsylvania. The Commission shall keep a full record of its business and shall annually make a written report by March 1 of each year of its activities to the Council of the Borough of Brentwood. Interim reports may be made as often as may be necessary or as requested by Council.

The Planning Commission shall have all powers and duties conferred upon them by the laws of the Commonwealth of Pennsylvania, including but not limited to the provisions of the Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended by Act 170 of 1988, and as otherwise amended,[1] and as conferred upon them by other provisions of the ordinances of Brentwood Borough, including but not limited to all of the Planning Commission powers and duties set forth in Chapter 210, Zoning, Article XI, Planning Commission.

The Borough Council may employ administrative and technical services to aid the Planning Commission in carrying out the provisions of this chapter and/or the provisions of the Pennsylvania Municipalities Planning Code, as amended,[1] either as consultants on particular matters or as regular employees of the Borough of Brentwood. The Planning Commission may, with the consent of the Borough Council, accept and utilize any funds, personnel or other assistance made available by Allegheny County, the Commonwealth of Pennsylvania, the federal government or any of their agencies or from private sources. The Council may enter into agreements or contracts regarding the acceptance or utilization of such funds or assistance in accordance with the governmental procedures of the Borough of Brentwood.

It is the intention of the Council of the Borough of Brentwood in adopting this chapter to create a Planning Commission as provided for, and in compliance with, the Act of Assembly approved July 31, 1968, entitled "Pennsylvania Municipalities Planning Code." If a final decision of a court of competent jurisdiction holds any provisions of this chapter or the application of any provision to any circumstances to be illegal or unconstitutional the other provisions of this chapter or the application of such provision to other circumstances shall remain in full force and effect. The intention of Council is that the provisions of this chapter shall be severable and that this chapter would have been adopted if any such illegal or unconstitutional provisions had not been included.
