As used in this chapter, a private swimming pool shall mean a pool of 24 inches or more in depth constructed, whether temporarily or permanently, at a single-family or two-family residential dwelling and available only to the occupants of the same and their guests.
A. 
An application for a permit to construct, install, alter or repair a private swimming pool shall be submitted to the Code Enforcement Officer on a form supplied by him and shall be accompanied by detailed plans and specifications, in duplicate, setting forth the extent and character of the installation in all its structural parts and a plot plan drawn to scale, showing the location of the proposed private swimming pool and all elevations.
B. 
The construction drawings accompanying the application for a permit shall bear the seal of an architect or engineer registered in the Commonwealth of Pennsylvania, certifying the adequacy of the construction of the proposed installation and the location as shown on the accompanying plot plan.
The permit fee for installation or alteration of private swimming pools shall be in accordance with permit fees for other construction of structures in the Borough of Brentwood.[1]

All private swimming pools shall comply with the health and sanitary regulations that pertain to swimming pools that are contained within the International Plumbing Code, 2018 edition, as published by the International Code Council, and the Allegheny County Plumbing Code, as incorporated as Chapter XV of the Allegheny County Health Department Rules and Regulations.
All private swimming pool installations shall comply with the provisions of Chapter 210, Zoning, with respect to building line requirements, said installation being considered as a building for application of Chapter 210, Zoning, except that the depth of the rear yard after the installation of a swimming pool shall be no less than 10 feet and except that said installation shall be deemed a part of the rear yard area.

All private swimming pools shall contain an outlet drain that facilitates the conveyance of wastewater to the sanitary sewer system. Any wastewater that drains from the swimming pool or an abutting deck, or any wastewater the backwashes from a swimming pool filter, shall be connected to the building drainage system through an indirect waste pipe by means of an air gap.
All private swimming pools, now existing or hereafter installed, shall be enclosed by an open-type ornamental fence, four feet in height, except that with respect to private swimming pools constructed above ground with a perpendicular sidewall exceeding three feet in height, such fence shall not be required, provided that access to the deck of the same is by removable steps or ladders and said steps or ladders are so removed when said private swimming pool is not in use.

Installation of swimming pools shall be subject to the terms of the Uniform Construction Code and the International Swimming Pool and Spa Code, in accordance with § 85-2 of the Brentwood Borough Code of Ordinances, and shall further be subject to the inspection and enforcement standards contained therein.
Any person, firm or corporation who or which shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, plus costs of prosecution and, in default of payment thereof, shall be imprisoned for a term not to exceed 30 days. Every day that a violation of this chapter continues shall constitute a separate offense.
