In addition to any relevant requirements of
the New Jersey Map Filing Act, N.J.S.A. 46:23 et seq., and as required
for stream corridors elsewhere in this chapter, preservation areas,
including cluster, common, usable and public open space, Delaware
& Raritan Canal Commission, NJDEP, and all other preservation
areas, shall have:
A. Approved survey markers conforming to Engineering
Department details and specifications located at all boundary corners
of preservation areas and intersecting property lines and such other
locations as shall be determined by the Planning Board or Board of
Adjustment; and
B. Preservation area markers located at all boundary
corners of preservation areas and other such locations as shall be
determined by the Planning Board or Board of Adjustment, in accordance
with the following specifications:
(1) Preservation area plaques shall be made of aluminum,
3 1/2 inches by 3 1/2 inches, and shall conform in design and color
with a sample plaque available for sale at a cost of $10 in the office
of the Township Clerk. Preservation area plaques shall be secured
to the upper faces of the posts facing the preservation area boundary.
(2) Preservation area plaques shall be placed on four
inches by four inches by five feet long pressure-treated lumber posts.
Posts shall be embedded into concrete to a depth of two feet, leaving
three feet exposed above the final grade or existing grade of the
surrounding land. Posts shall be located one foot inside of the preservation
area boundary line adjacent to all monuments and other approved survey
markers set in compliance with N.J.S.A. 46:23 and as required by the
Planning Board or Board of Adjustment.
(3) Preservation
area boundary lines shall be established by a licensed land surveyor
and shall be shown on the final subdivision or final site plan map.
Bearings and distances around the preservation area and proposed or
existing locations of preservation area markers shall also be shown
on the map.
(4) All
costs for the establishment of location, marking, purchase and installation
of approved survey markers and preservation area markers shall be
borne by the applicant/developer.
(5) If
boundary lines are in excess of 300 feet, preservation area markers
shall be equally spaced at maximum intervals of 300 feet.
(6) Where
preservation area boundaries overlap (i.e., wetland transition areas
and floodplain areas) the most-restrictive boundary limits shall be
established as the Township preservation area boundary line.
(7) Existing
survey markers shall not be removed to be replaced by preservation
area survey markers. Lumber posts with preservation area plaques shall
be set adjacent to the existing survey markers as directed elsewhere
in this article. Where preservation area survey markers coincide with
proposed concrete monuments, the monuments shall be set along with
the lumber post with plaque.
(8) Preservation
area easements shall be shall be dedicated to the Township by deed
filed in the County Clerk’s office in addition to the requirements
of any other agency.
