Notwithstanding any other law to the contrary, the
Board of Trustees may exercise the powers otherwise vested in the
Planning Board, the Board of Appeals or the Architectural Review Board
with respect to any property for which incentive zoning is, or heretofore
has been, authorized by local law enacted pursuant to Village Law
§ 7-703.
In exercising such authority, the Board of Trustees
may not perform any act, make any determination, or authorize any
use or development of property which is not authorized by law, or
which could not have been authorized by the Board of Trustees, Planning
Board, Board of Appeals or Architectural Review Board but for the
provisions of this article.
In any such case, or with respect to any such application,
it shall be presumed that the Board of Trustees shall exercise the
authority provided in this section, and such case or application shall
be considered and determined by the Board of Trustees, unless the
Board of Trustees shall determine that the case or application should
be considered and determined by the board or boards which would have
had such jurisdiction but for the provisions of this chapter.
