Pursuant to the Uniform Fire Safety Act (P.L.
1983. c. 383, N.J.S.A. 52:27D-192 et seq.), the New Jersey Uniform
Fire Code shall be enforced locally within the Township of Franklin.
The local enforcing agency shall be the Department
of Fire Prevention.
A.
Membership. The Fire Prevention Board shall consist
of five members by written appointments. Four members shall be Fire
Commissioners, including one Commissioner from each Fire District
of the Township of Franklin. The duration of term of the Fire Prevention
Board members shall be established by the Fire Districts collectively.
The fifth member of the Fire Prevention Board shall be a member of
the Franklin Township Fire Chiefs Association, to be appointed on
an annual basis by said Association. Said member may not concurrently
serve as a Fire Commissioner during the term of appointment.
B.
Alternates. There shall be five alternate members
of the Fire Prevention Board by written appointment, one for each
regular Board member. Alternate members shall be appointed by their
respective organizations and may attend all meetings of the Board.
They shall be entitled to vote on Board matters in the absence of
their respective regular members.
C.
Liaison. There shall be one regular and one alternate
Township Council liaison member who shall be appointed by the Township
Council for one-year terms.

A.
There is hereby established a Department of Fire Prevention,
which shall be headed by a Fire Official who shall be known as the
"Director of Fire Prevention." Said Fire Official shall be appointed
by the Township Manager after consultation with the Fire Prevention
Board.
B.
Said Department of Fire Prevention shall include such
inspectors and other employees as are deemed necessary for the day-to-day
operation of the Department.
C.
The salaries, benefits, personnel regulations and
terms of office for all employees of the Department of Fire Prevention
shall be in accordance with the standards as promulgated for all other
nonpolice employees of the Township of Franklin.
E.
Such funds as mutually deemed necessary by the Fire
Prevention Board and the Township Council shall be reflected in the
local municipal budget.
F.
The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted pursuant thereto in all buildings, structures and premises within the Township of Franklin, other than owner-occupied one- and two-family dwellings. (See Article IV exceptions.)
G.
The local enforcing agency shall carry out the periodic
inspections of life hazard uses required by the Uniform Fire Code
on behalf of the Commissioner of the New Jersey Department of Community
Affairs.
A.
Pursuant to Sections 15 and 17 of the Uniform Fire
Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208, respectively), any
person aggrieved by any order of the local enforcing agency shall
have the right to appeal to the Construction Board of Appeals of the
County of Somerset or to the Franklin Township Board of Appeals, if
constituted.[1]
B.
Appeals for any action of the Fire Official which
are not directly related to the New Jersey Uniform Fire Code or local
amendments shall be made, in writing, to the Franklin Township Board
of Fire Prevention.
