There is hereby adopted in full and incorporated
herein by reference all of the provisions of P.L. 1954, c. 199, entitled
the "Realty Improvement Sewerage and Facilities Act" (N.J.S.A. 58:11-23
et seq.), as well as "Standards for Individual Subsurface Sewage Disposal
Systems."
Ten copies of said P.L. 1954, c. 199, as well
as 10 copies of the aforesaid standards for the construction of individual
subsurface sewage disposal systems, shall be placed on file in the
office of the Township Clerk and in the office of the Public Health
Department and shall be available for examination by the public during
normal business hours.

A. Section 7:9A-6.4(f)1. If any of the percolation rates
are slower than 40 minutes per inch or faster than three minutes per
inch, the application shall not be approved.
B. Section 7:9A-6.4(f)2. When the result of the test(s)
is an average percolation rate slower than 40 minutes per inch, the
horizon or substratum in question shall be considered hydraulically
restrictive.
C. Section 7:9A-12.8. When it is necessary to abandon
a system or components of a system in place for any reason, all septic
tanks, dosing tanks, seepage pits, dry wells and cesspools which are
to be abandoned shall be emptied of wastes and removed or filled completely
with gravel, stones, or soil material in a manner which is acceptable
to the administrative authority. In cases where the individual subsurface
sewage disposal system, or components thereof, is being abandoned
due to the connection of a facility to a sanitary sewer line, the
Township's Health Department and the local Plumbing Inspector shall
ensure the system is abandoned in accordance with the requirements
of this section.
D. Section 7:9A-10.1(f)4. When fill material is utilized
within the zone of treatment, the fill material shall meet the following
requirements:
(1) Coarse fragment content less than 15% by volume or
less than 25% by weight;
(2) Textural analysis (composition, by weight, of size
fraction passing the 2 mm sieve): from 85% to 95% fine to coarse sand,
from 5% to 15% very fine sand plus silt and clay, minimum 5% to 15%
silt plus clay, minimum 2% clay; and
(3) Permeability from six to 20 inches per hour, or percolation
rate from three to 15 minutes per inch.
E. Section 7:9A-10.4(f). Fill material used in soil replacement
disposal field installations shall meet the following requirements:
(1) The fill material used below the disposal field shall
meet the requirements for texture and permeability which are prescribed
in 7:9A-10.1(f); and
(2) A minimum of two percolation tests shall be conducted
at the level of infiltration after the fill material has been installed.

A. The Township of Franklin shall have the option, with
respect to any percolation test(s) performed on any premises which
shall be the subject of any application for development and classified
as a major subdivision or, if no such application for development
is yet pending, which shall require the performance of four or more
percolation tests within a one-year period, to require the applicant
therefor to post an escrow with the Township in the amount of $300
for each percolation test to be so performed.
B. Upon the posting of such escrow, the Township may
designate an authorized agent to supervise the performance of such
tests, who shall be a licensed health officer, professional engineer
or sanitary inspector or Plumbing Subcode Official and who shall be
retained in accordance with the provisions of the Local Public Contracts
Law, N.J.S.A. 40A:11-1 et seq. Any sums not so expended shall be refunded
within 60 days after completion of such tests.

The Health Department shall have a period of
20 working days from the date of the submission of complete plans
in order to issue an approval, conditional approval or denial thereof.

A. Any permit issued for the installation or alteration
of an individual sewage disposal system shall be valid for a period
of one year after the date of issuance.
B. All approvals for the design of an individual sewage
disposal system shall be valid for a period of two years from the
date of such approval.
C. Results of permeability tests of soils for subsurface
sewage disposal systems shall be valid for two years after the date
of completion of tests.

A. For the review of a plan for a new residential septic
system prior to permit issuance: $100.
B. For the review of a plan for a new commercial/industrial
septic system prior to permit issuance: $200.
C. For the review of a plan for the alteration or repair
of a residential, commercial or industrial septic system: $50.
D. For a permit to abandon a septic system: $20.
Any violation of the provisions of this article shall be punishable as provided in Chapter
1, Article
II, General Penalty.
