The City of Peekskill is hereby divided into the following zoning
districts:

The boundaries of said districts are hereby
established as shown on the Zoning Map, City of Peekskill, dated October
17, 1977, which accompanies this chapter and which, with all explanatory
matter thereon, is hereby adopted and made a part of this chapter.
Said map, indicating the latest amendments, shall be kept up-to-date
in the office of the City Clerk for the use and benefit of the public.
In determining the boundaries of districts shown
on the map, the following rules shall apply:
A. Where such boundaries are indicated as approximately
following the center lines of streets, alleys, parkways, waterways,
main track or tracks of railroads, property lines of parks or other
publicly owned land or lot lines, such lines shall be construed to
be such boundaries.
B. In all cases where a district boundary divides a lot
in one ownership and more than 50% of the area of such lot lies in
the less restricted district, the regulations prescribed by this chapter
for the less restricted district shall be deemed to extend not more
than 30 feet into the portion of the lot lying in the more restricted
district. For purposes of this section, the "more restricted district"
shall be deemed that district which is subject to regulations which
prohibit the particular use intended to be made of said lot or which
regulations require higher standards with respect to setback, coverage,
yards, screening, landscaping and similar requirements.
C. Unless otherwise shown, all district boundaries running
parallel to streets shall be construed to be 100 feet back from the
right-of-way.
D. In all cases where a district boundary is located
not farther than 15 feet away from a lot line of record, the boundary
shall be construed to coincide with such line.
E. In all other cases where dimensions are not shown
on the Zoning Map, the location of boundaries shall be determined
by the use of the scale appearing on such map.
F. Any boundary shown extended into the Hudson River
and/or Peekskill Hollow Brook, as the case may be, shall be deemed
to extend to the boundary of the City, unless otherwise indicated.
Following the effective date of this chapter:
A. Conformity required. No building shall be erected,
moved, altered, rebuilt or enlarged nor shall any land or building
be used, designed or arranged to be used for any purpose or in any
manner except in conformity with all regulations, requirements and/or
restrictions specified in this chapter for the district in which such
building or land is located.
B. Required open spaces; yards; division of existing
lots.
(1) No yard or open space required in connection with
any building or use shall be considered as providing the required
open spaces for any other building on the same or any other lot.
(2) Except as permitted hereinafter, no lot shall be formed
from part of a lot already occupied by a building unless such building,
all yards and open spaces connected therewith and the remaining lot
comply with all requirements prescribed by this chapter for the district
in which said lot is located. No permit shall be issued for the erection
of a building on any new lot thus created unless such building and
lot comply with all the provisions of this chapter. In cases where
two or more buildings erected prior to the effective date of this
chapter occupy one lot, the division of said lot in such a way as
to establish a separate lot for each of said buildings may be authorized,
upon application, by the Zoning Board of Appeals. In considering such
application the Board shall endeavor to secure minimum possible deviations
from the provisions of this chapter.
C. Existing vacant lots.
(1) The minimum lot width or area regulations, or both,
shall not apply to any lot with an area and/or width of less than
that prescribed herein, provided that:
(a)
Such lot was in different ownership from that
of any adjoining land on the effective date of the 1960 City of Peekskill
Zoning Ordinance and is still in separate ownership at the time of
application for a building permit.
(b)
Such lot was a conforming lot or a legal noncomplying
lot under a City zoning ordinance prior to 1960.
(c)
Such lot shall be subject to all other applicable
regulations prescribed by this chapter.
(2) In any area where the prevailing lot width, depth
and/or lot area and/or building setback is below the requirements
of this chapter, the Zoning Board of Appeals may consider compliance
with said requirements to cause unnecessary hardship and/or practical
difficulty and may, therefore, vary such requirements, provided that
the resultant lot width, depth and/or lot areas and/or building setback
shall be in harmony with the pattern of development prevailing in
such area.
D. Completion of structures for which permits have been
issued. Nothing contained in this chapter shall require any change
in the plans, construction or designated use of a building complying
with existing law for which a building permit application has been
accepted by the Director.
E. One building per lot. In any R-1, R-2 or R-3 District,
only one principal building shall be permitted per lot.
