The position of Animal Control Officer is hereby
created. Such person shall be educated in the care, seizure, custody
and confinement of animals. Such person shall be appointed by the
Town Board.
The Animal Control Officer shall:
A. Enforce all of the provisions of this chapter and
have all of the powers and duties as are set forth in Article 7 of
the Agriculture and Markets Law of the State of New York.
B. Have no responsibilities or powers relating to domestic
cats.
C. Take the training required by the State Department
of Environmental Conservation so as to receive the Nuisance Wild Life
Control Permit issued by that state department.
D. Be protected against rabies by preexposure vaccination.
E. Report cases of cruelty or suspected cruelty to animals
to the Humane Society of Rochester and Monroe County.
F. Render assistance to residents of the Town whose persons
and/or property are threatened by wild animals.
G. Destroy or arrange for the destruction of animals
with rabies or suspected of being rabid and, when required, arrange
for the delivery of the destroyed animal's brain to the Monroe County
Department of Health.
H. Deliver injured wildlife to a New York State licensed
rehabilitator.
I. Deliver sick wildlife, other than those with rabies
or those suspected of being rabid, to a duly licensed veterinarian.
J. Cooperate with New York State and Monroe County wildlife
officers and police and peace officers in dealing with wildlife problems.
The Animal Control Officer is authorized to
issue appearance tickets for violations of this chapter and/or any
other law which the Animal Control Officer is responsible for enforcing.
