No person shall use or consume any alcoholic
beverage, as defined in MGL c. 138, § 1, while in or upon
any public way or any way which the public has a right of access or
in any place where the public may be invitees or licensees; nor shall
any person use or consume any alcoholic beverage in or upon any private
land, building or structure without the consent of the owner or person
in control thereof. However, the Board of Selectmen may issue special
licenses under G.L. c. 138 for the sale of alcoholic beverages at
events that take place on Town property or, upon written application,
may provide written authorization allowing for the consumption of
alcoholic beverages on Town property.
All alcoholic beverages being used in violation
of this Article shall be seized and safely held until final adjudication
of charges against the person or persons arrested or summoned before
the court, at which time they shall be returned to the person entitled
to lawful possession.
Any person upon conviction under this Article
shall be fined a sum not exceeding $50 for each offense.
