The Board of Appeals shall have the power to grant variances as provided by law (MGL c. 40A, § 10). Such variance may authorize use or activity not otherwise permitted in the district in which the land or structure is located.

There shall be a Board of Appeals of five members and three associate members appointed by the Selectmen as provided in MGL c. 40A, § 12, which shall act on all matters within the jurisdiction under this articlein the manner prescribed in said chapter and shall act as the Board of Appeals under the subdivision control law as provided in MGL c. 41, § 81Z. One of the members appointed in 1969 shall serve until March 1974, another shall serve until March 1973, another shall serve until March 1972. Present members shall serve until the expiration of their respective terms. Each successor shall serve a five-year term. Associate members shall be appointed annually.
The term of office of every member and associate member shall commence on the fourth Monday of May of the appropriate year or as soon after said fourth Monday as he shall be sworn, and he shall serve until his successor is appointed and qualified. This section shall take effect commencing in May 1978.
