It shall be unlawful for the owner and/or operator
of any motor vehicle to park it or permit it to be parked within or
on the right-of-way of any Chestnuthill Township road.
Any vehicle parked or permitted to be parked
on or within the right-of-way of any Chestnuthill Township road in
violation of this article is hereby declared to be a nuisance and
to be a safety hazard and to be unduly interfering with the free movement
of traffic.
As used in this article, the following terms
shall have the meanings indicated:
To stop, stand or rest a vehicle, whether occupied or not,
for any period of time.
Any natural person, partnership, firm, association or corporation.
In the event that a motor vehicle parked in
a prohibited area is unattended or without a known operator, then
the registered owner thereof shall be legally liable for the purposes
of this article.
Notwithstanding any provision hereof to the
contrary, parking at any prohibited location shall be allowed to avoid
conflict with compliance with the directions of any police officer
or in the event of an emergency.

Any police officer, or the Road Master, Fire
Marshal, Fire Chief, Zoning/Code Enforcement Officer or any other
agent so designated by the Township, may remove or cause to be removed
to a nearby garage or other place of safety any vehicle found upon
or within the right-of-way of any Chestnuthill Township road in violation
of this article. Any motor vehicles so removed shall be the owner's
responsibility for all expenses incurred for towing charges and storage
and at the owner's risk of damage. Such vehicles shall be held until
the charges for towing and storage have been paid, together with any
penalties under this article.

The Police Officer, Road Master, Fire Marshal, Fire Chief, Zoning/Code
Enforcement Officer, or any other agent so designated by the Township,
is hereby authorized to issue citations for the violation of this
chapter. Among other methods, issuance of the citation may be accomplished
by placing the same on the vehicle or other obstruction within the
right-of-way.

Any person who violates or permits a violation
of this article shall, upon conviction in a summary proceeding brought
before a District Justice under the Pennsylvania Rules of Criminal
Procedure, be guilty of a summary offense and shall be punishable
by a fine of not more than $1,000, plus costs of prosecution. In default
of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this article that is violated
shall also constitute a separate offense.
