No person shall dispose of industrial waste,
sludge or sewage sludge in a licensed disposal area without first
obtaining a license for such disposal. The requirements of this section
shall apply only to originators or manufacturers of such material
within the Town and not to transporters or collectors of such material
within the Town or elsewhere.
Any person disposing of industrial sludge, waste
or sewage sludge prior to the enactment of this article must conform
to the provisions of this article within 180 days of the adoption
of this article.
In applying for a license pursuant to this article,
the applicant shall file with his application and accompanying fees
documents setting forth the nature and volume of the material being
disposed, the toxic effect of the material, if any, the type of transportation
to be used, and the method of disposal of the material. The route
to be used shall be subject to the approval of the Highway Engineer
of the Town.
Each application for the issuance or renewal of a license to dispose of industrial sludge, waste or sewage sludge shall be accompanied by a nonrefundable filing fee as set forth in Chapter
122, Fees. The fee for a license to dispose of such material in a disposal area in the Town shall also be as set forth in Chapter
122, Fees, and shall be paid together with the filing fee. The fee for the license is refundable if the Town Council does not approve the application for the license.
The Town Council shall hold a public hearing for applications for a license issued pursuant to this article. The provisions set forth in §§
142-18 and
142-19 shall apply to applications for licenses issued under this article with the same force and effect as if set out in full in this article.
The license to dispose of industrial sludge,
waste or sewage sludge in a licensed disposal area within the Town
shall be issued for a period not exceeding six months, and shall not
be transferable.
Any person seeking to renew a license to dispose
of industrial sludge, waste or sewage sludge shall complete and submit
to the Town Council an application therefor not more than 60 days
nor less than 30 days before the expiration date thereof, and shall
tender with each application the filing fees, license fees, and other
documentary material required by this article.
