A permit shall be defined as a written application
filed by a person with the Town Clerk's office seeking permission
to plant, cut, trim, prune or remove, in full or in part, any shrub,
ornamental or shade tree located on Town roads or in public places
under the control of the Tree Warden within the Town. Neither the
Town Tree Warden nor the Department of Public Works is required to
obtain permits under this definition. A person securing the permit
from the Town shall abide by the arboricultural standards of practice
recognized by the State Department of Environmental Management and
shall also abide by all state and local regulations governing arboricultural
practices.
All fees collected by the Town Clerk's office
under the provisions of this chapter shall be accounted for in the
following manner:
A. Fifty percent of such fees shall be paid into the
general funds of the Town for further appropriation.
B. Fifty percent of such fees shall be paid into the
general funds and paid by the Town Treasurer to the Tree Warden monthly.
