Editor’s Note: This local law also repealed former Art. VII, Alternate Members of Planning Board and Zoning Board of Appeals, adopted 4-19-1999 by L.L. No. 2-1999.
For various reasons, including illnesses, vacations and conflicts of interest, it is sometimes not possible to obtain or maintain a quorum of the Planning Board and of the Zoning Board of Appeals. Such failure to obtain or maintain a quorum may delay or impede such Boards in meeting their responsibilities. The purpose of this article is to authorize the appointment and service of up to three alternate members of each of the Planning Board and Zoning Board of Appeals.
As used in this article, the following terms shall have the meanings indicated:
ALTERNATE MEMBER OF THE PLANNING BOARD
An individual appointed, as provided herein, to serve on the Planning Board when required to obtain or maintain a quorum.
ALTERNATE MEMBER OF THE ZONING BOARD OF APPEALS
An individual appointed, as provided herein, to serve on the Zoning Board of Appeals when required to obtain or maintain a quorum.
PLANNING BOARD
The Planning Board of the Village of Akron.
ZONING BOARD OF APPEALS
The Zoning Board of Appeals of the Village of Akron.
A. 
Any alternate member of the Planning Board shall, subject to the approval of the Board of Trustees, be appointed by the Mayor for a term of five years. All provisions of state law relating to Planning Board member eligibility, vacancy in office, removal, compatibility of office and service on other boards, as well as any provisions of a local law or ordinance relating to training, continuing education, compensation and attendance, shall also apply to any alternate member of the Planning Board.
B. 
Any alternate member of the Zoning Board of Appeals shall, subject to the approval of the Board of Trustees, be appointed by the Mayor for a period of five years. All provisions of state law relating to Zoning Board of Appeals member eligibility, vacancy in office, removal, compatibility of office and service on other boards, as well as any provisions of a local law or ordinance relating to training, continuing education, compensation and attendance, shall also apply to any alternate member of the Zoning Board of Appeals.
C. 
The Chairperson of the Planning Board may designate any alternate member of the Planning Board to serve when necessary, and only so long as necessary, to obtain or maintain a quorum of such Board. Such designation and its expiration shall be entered into the minutes of the Planning Board. When so designated, any alternate member of the Planning Board shall possess all the powers and responsibilities of a member of such Board.
D. 
The Chairperson of the Zoning Board of Appeals may designate any alternate member of the Zoning Board of Appeals to serve when necessary, and only so long as necessary, to obtain or maintain a quorum of such Board. Such designation and its expiration shall be entered into the minutes of the Zoning Board of Appeals. When so designated, any alternate member of the Zoning Board of Appeals shall possess all the powers and responsibilities of a member of such Board.
E. 
The Mayor, subject to the approval of the Village Board, may appoint up to three alternate members of each of the Planning Board and Zoning Board of Appeals.
