In order to promote its aesthetic well-being and public safety the Village of Skaneateles hereby precludes the installation of all coin-operated vending devices on its sidewalks within the municipal right-of-way with the exception of three locations for the vending of newspapers. These exceptions will promote public access to newspapers on a twenty-four-hour basis at locations which do not create traffic safety dangers in the Village of Skaneateles.
As used in this article, the following terms shall have the meanings indicated:
NEWSPAPER VENDING DEVICE
A mechanical coin-operated container constructed of metal or other material of substantially equivalent strength and durability.
These locations are designated as follows:
A. 
36 East Genesee Street, Skaneateles, New York.
B. 
3 East Genesee Street, Skaneateles, New York.
C. 
In the Village Municipal Parking Lot, east of the southeast corner of the Village Square Mall building.
D. 
At the Skaneateles Community Center. [1]

A. 
Newspaper vending devices shall not be placed in the residential use districts of the Village and shall be adjacent and parallel to building walls not more than six inches distant therefrom or near and parallel to the curb not less than 18 inches and not more than 24 inches distant from the curb at the three locations designated by the Board of Trustees, which locations have been selected because they do not cause an undue health or safety hazard.
B. 
It is further provided that no newspaper vending device shall be placed, installed, used or maintained:
(1) 
Within five feet of any hydrant or other emergency facility.
(2) 
Within five feet of any intersecting driveway, alley or street.
(3) 
Within any three feet of any marked crosswalk.
(4) 
At any location where the width of paved clear space in any direction for the passageway of pedestrians is reduced to less than five feet.
The permittee shall maintain the devices in good working order and in a safe and clean condition and keep the immediate area surrounding such device free from litter and debris.
If the newspaper vending device is not used for a period of six months, then it is the responsibility of the owner to remove the device from the premises.
A permit shall be issued upon application by the newspaper vendor and shall remain in force providing the vendor complies with the regulations set forth in this article.
