It shall be unlawful for anyone to construct
private sanitary sewers from the public sewer to any building, structure
or premises; to install house drains or soil, waste and vent pipes;
to set any fixture eventually connected to the sanitary sewer system;
or to alter or change any existing house drain, soil, waste or vent
pipe or fixture presently connected to the sanitary sewer system unless
such construction, installation, setting or alteration shall comply
with the terms of this chapter or the alteration to existing plumbing
has been approved by the Code Enforcement Officer and a permit issued,
provided that no permit is required if the only work to be done is
repairs as defined in the BOCA National Plumbing Code.
There is hereby adopted all of the provisions and sections of Chapter 98, Administration and Enforcement, regulating the administration and enforcement of the Housing (Chapter 132), Building (Chapter 108), Plumbing (Chapter 147), Electrical (Chapter 121) and Fire Prevention (Chapter 279) Codes for Latrobe.
The Code Enforcement Officer shall receive all applications for permits, issue permits and conduct any and all inspections under this code and shall issue all notices of violations thereof as provided for in Chapter 98, Administration and Enforcement.

There is hereby adopted by Latrobe for the purpose
of establishing minimum standards for the construction of plumbing
and house or building drainage in all buildings, structures and premises
in Latrobe that certain plumbing code known as the "BOCA National
Plumbing Code," 1993 Edition, and any amendments thereto, and the
same is hereby adopted and incorporated herein by reference as if
fully set out herein, and the provisions thereof shall be controlling
as to the buildings, structures and premises within Latrobe from the
time this chapter shall take effect.

The edition of the BOCA National Plumbing Code
now in effect is amended and changed as set forth below. To the extent
that the current edition of the 1993 BOCA National Plumbing Code or
any subsequent amendment, addition or supplement thereto establishes
a higher standard than the amendments set forth below, then in that
event the higher standard of either the BOCA Code or the ordinance
amendment shall be applicable to the extent there is any conflict
between the amendments set forth below and the applicable BOCA National
Plumbing Code. The amendments are:
A.
The section regarding violations, is amended to read as follows: "Any violation of this code shall be enforced under the provisions and sections of Chapter 98, Administration and Enforcement, regulating the administration and enforcement of the Housing (Chapter 132), Building (Chapter 108), Plumbing (Chapter 147), Electrical (Chapter 121) and Fire Prevention (Chapter 279) Codes for Latrobe."
B.
The section regarding definition of terms, shall be amended by defining "administrative authority" as the Office of Code Enforcement as established in Chapter 98, Administration and Enforcement.
C.
The section regarding connections to plumbing systems
is hereby amended to read as follows: "The water distribution and
drainage system of any building in which plumbing fixtures are installed
shall be connected to a public water supply and sewer system, respectively.
No new installations of water distribution or drainage systems are
allowed that are not connected to a public water supply and sewer
system."
D.
The section regarding protection of pipes from freezing
shall be amended to read as follows: "Water service piping and sewers
shall be installed below recorded frost penetration but not less below
grade than four feet for water piping and four feet for sewers. Piping
in exterior building walls shall be adequately protected against freezing
by insulation or heat, or both."
E.
The Appendix regarding typical symbols and drawings
is deleted.
A.
Whenever it shall come to the knowledge of the Code
Enforcement Officer or a complaint in writing shall be made by any
citizen of Latrobe that the plumbing or drainage of any building has
become a nuisance or is contrary to the provisions of this chapter
or is of faulty construction and is liable to breed disease or endanger
the health of the occupants, then the Code Enforcement Officer shall
examine or shall have examined the plumbing or drainage in any such
building. The Code Enforcement Officer shall make a drawing of the
plan of said plumbing, drainage and sewer and ventilating shaft connections
and shall suggest such changes to make the building conform to the
regulations governing such matters.
B.
The Code Enforcement Officer shall thereupon notify the owner, operator or agent of any such building, in conformity with the notice requirements of Chapter 98, Administration and Enforcement, of the changes which are necessary in such plumbing or drainage. In addition to the requirements of the provisions of such notice, the notice may also contain the statement that unless the changes are made within the time affixed by the Code Enforcement Officer, the Code Enforcement Officer shall have instituted legal proceedings to have such changes made or nuisance abated.
C.
Upon refusal and neglect of the owner, operator or agent to obey such notice, the Code Enforcement Officer is authorized to institute legal proceedings to have such changes made and said nuisance abated. In these proceedings, the owner, operator or agent may show in defense that the plumbing or drainage was not a nuisance or was not a faulty construction or out of repair, and in the case of a building constructed subsequent to the passage of this chapter, such plumbing or drainage was not contrary to the provisions and requirements of this chapter. This is in addition to the penalties provided in Chapter 98, Administration and Enforcement.
If any provision of this chapter is found to be in conflict with any provision of Chapter 166, Zoning or the Building (Chapter 108), Electrical (Chapter 121), Housing (Chapter 132) or Fire Prevention (Chapter 279) Codes of Latrobe in force on the effective date of this chapter, the provision which establishes the highest standard for the promotion and protection of the health and safety of the people shall prevail.
This chapter shall be known hereafter as the
"Latrobe Plumbing Code."
