For the purposes of this article, the following
terms shall have the meanings indicated:
OPERATOR
The person who is in actual physical control of a vehicle.
PARKING LOT NO. 1 or PLAZA NORTH
All the municipally owned land and area lying north of the
railroad right-of-way and south of Main Street and bounded on the
east by Fairmount Avenue and on the west by Lot 8, Block 104, as shown
on the current Tax Maps of the Borough of Chatham.

PARKING LOT NO.2 or PLAZA SOUTH
All the municipally owned land and area lying south of the
railroad right-of-way and north of the property of the Board of Education
extending from Fairmount Avenue to Front Street.
PARKING LOT NO.3 or BOWERS LANE LOT
All the municipally owned land and area extending from Bowers
Lane to the rear of properties bordering on Passaic Avenue and from
the southerly side of the United States Post Office property to the
northerly side of the railroad right-of-way.
PARKING LOT NO. 7 or FIREHOUSE PLAZA LOT
All the municipally owned land and area lying north of the
railroad right-of-way and south of Main Street and bounded on the
east by Passaic Avenue and on the west by Fairmount Avenue.

PERSON
Natural persons, firms, copartnerships, associations and
corporations.
VEHICLE
Any device in, upon or by which a person or property is or
may be transported upon a highway, excepting devices moved by human
power or used exclusively upon stationary rails or tracks.

For the purpose of implementing the provisions
of this article, the Police Committee of the Borough Council, through
the Chief of Police and the Police Department, is charged with the
responsibility of developing entrances and exits, marking off the
parking spaces, the installation of collection devices and signs and
generally working out the details of setting up and maintaining the
parking lots referred to hereinafter so as to secure the maximum number
of parking spaces consistent with safety and the orderly flow of traffic.

A. Parking fees required to be paid in parking lots or
areas hereinafter designated fee parking, and when signs are erected,
as well as rules and regulations governing the sale of parking tokens
and parking permits, shall be established and designated by Council
by resolution.
B. All fee parking areas shall be served by a collection
device or devices. Each such device shall collect and retain the parking
fee for each parking space it serves. Each fee parking space shall
be identified and related by number or otherwise, and such identification
shall be registered when paying the daily parking fee.
C. All persons using a fee parking space shall deposit
the daily fee in the parking device, entering the number of the space
parked in, by United States coin, the amount of the fee as established
or such other form as may be authorized by Council resolution.

A. Parking by permit may be allowed in the parking lots specified in §
139-63. The Council shall designate by resolution such areas in such of said parking lots as it deems appropriate for permit parking. The procedure for the issuance of parking permits, the classes of persons eligible for permits, the number of spaces to be set aside for permit use, the number of permits to be issued, the lots for which issued, the charge to be made for such permits, the method of identifying the permit holders, the frequency of the issuance of permits and the method of distributing permits likewise shall be designated by resolution.
B. No vehicle shall be parked in a parking space reserved
for permit parking as indicated by signs erected for that purpose
unless a valid permit for that lot is properly affixed to the vehicle.
C. The number of parking permits issued shall be reasonably
related to the number of spaces designated for permit parking, but
possession of a valid parking permit shall not constitute a guarantee
of a parking space nor excuse or justify illegal parking.
D. Only permits issued by the Borough of Chatham to Borough
residents shall be valid. A violation of this article shall exist
if the permit is displayed on any vehicle other than a vehicle on
file in the Borough Clerk's office.

The parking lots listed below are
to be regulated as indicated below when signs are erected giving clear
indication of such regulations. The Borough Council may by resolution
relax the time limits on parking in these parking lots by resolution
when it deems necessary for holidays, emergencies, construction or
for other good cause.
A. Parking Lot No. 1: fee parking, permit parking and
time limit parking where designated.
B. Parking Lot No. 2: fee parking and permit parking
where designated.
C. Parking Lot No. 3: free parking with a maximum limit
of three hours, fee parking and permit parking where designated.
D. Parking Lot No. 4: free parking with a maximum limit
of three hours, except the four spaces closest to the Post Office
Building, which shall have a maximum limit of 15 minutes.
E. Parking Lot No. 5: free parking with a maximum limit
of two hours.
F. Parking Lot No. 6: free parking with a maximum limit
of three hours, Monday through Saturday from 8:00 a.m. to 6:00 p.m.,
and fee and permit parking where designated.
G. Parking Lot No. 7: free parking on the northerly side
line of the lot with a maximum limit of 90 minutes between the hours
of 8:00 a.m. and 6:00 p.m. and a maximum limit of three hours between
the hours of 6:00 p.m. and 8:00 a.m.; however, no parking shall be
permitted at any time on the southerly side line of the lot.
H. Parking Lot No. 8: free parking with a maximum limit
of three hours, Monday through Saturday from 8:00 a.m. to 6:00 p.m.,
and fee and permit parking where designated.
I. Parking Lot No. 9 or Park and Ride Lot: free parking
with a maximum limit of two hours; permit parking where designated.
J. Parking Lot No. 10 at Firemen’s Firehouse Plaza Lot: free parking for members of the Chatham Borough Volunteer Fire Department only, in accordance with procedures to be established by the Fire Chief of the Borough of Chatham. Parking by the public is strictly prohibited and will be strictly enforced in accordance with §
139-64 entitled "Violations; removal of vehicles."
K. Parking Lot No. 11 at Library of the Chathams: free parking with
a maximum limit of three hours.

A. A parking space shall be created at the Division Avenue
Park and Ride to be utilized exclusively for RIDEPROVIDE and waiving
any and all fees associated with parking at this location.
B. The effectiveness of this section is contingent upon
a sign being erected as required by municipal ordinance.
C. Unless another penalty is expressly provided under
New Jersey statute, any vehicle and/or person who violates the provision
of this section or any supplement thereto may be liable for a penalty
of not more than $50.
A. It shall be unlawful and a violation of this article
for anyone to use any portion of the parking lots referred to herein
in any fashion other than is permitted herein.
B. In addition to issuing a summons for the violation
of this article, the Police Department may move or cause to be moved
from any parking lot herein described any unattended vehicle parked
or standing in any portion of any parking lot not designated as a
parking space or any unattended vehicle parked or standing in a designated
parking space which has remained there for a period of 10 hours after
a summons has been issued charging a violation hereunder. When a vehicle
is so removed from a parking lot, the owner of said vehicle shall
pay, before being entitled to the recovery or possession of said vehicle,
all reasonable charges for towing, storage and other expenses incurred
in removal of said vehicle.

A. All persons using a fee or permit parking space shall
park their vehicles within the space designated by the white line
markings with the front of the vehicle facing to the front of the
space or "head-in," as that term is commonly understood. Vehicles
unable to fit within the confines of such white line markings are
prohibited from vehicle, all reasonable charges for towing, storage
and other expenses incurred in removal of said vehicle. Parking in
such space and will be in violation of this article even though the
required fee has been paid or permit obtained.
B. No one shall use any fee or permit parking space for
stopping or waiting except on payment of the fee or with a proper
permit, as the case may be.

It shall be unlawful and a violation of this
article for any person to deface, impair, tamper with, open or willfully
break, destroy or impair the usefulness of any collection device or
sign installed under the provisions of this article.
The Police Department of the Borough of Chatham
is herewith charged with the responsibility for the enforcement of
the provisions of this article. The Chief of Police shall assign such
personnel as he shall deem necessary to properly maintain control
of the parking lots and enforce the provisions of this article. For
this purpose all police officers of the Borough of Chatham, both regular
and special, are hereby given full power and authority to enforce
the various provisions of this article.

Unless a different penalty is expressly provided
by this Code or the Borough Local Supplemental Violations Bureau Schedule,
any person who is found guilty of violating or failing to comply with
any provision of this article shall be punishable by a fine not exceeding
$500 or by imprisonment for a period not exceeding 30 days, or by
both such fine and imprisonment, to be at the discretion of the Judge
of the Municipal Court of the Borough of Chatham.
A. Words and phrases used in this article, unless other
meaning is clearly apparent from the language or context, shall have
the same meaning as the words and phrases used in Title 39 of the
Revised Statutes of New Jersey.
B. All hourly times mentioned herein shall refer to the
prevailing time lawfully in effect.
C. For the purposes of this article, the following word
shall have the meaning indicated:
PARKING
The standing or waiting of a vehicle on a street, driveway,
parking lot or other area usable by motor vehicles when not actually
engaged in receiving or discharging passengers or merchandise unless
in obedience to traffic regulations or traffic signs or signals.
It shall be unlawful for any person to do any
act forbidden or fail to perform any act required in this article.

The driveways, entranceways and exitways of
the Chatham Middle School, Milton Avenue School and Washington Avenue
School are restricted to use for entrance to and exit from the respective
school buildings and grounds, and the use thereof as throughways or
thoroughfares is prohibited.
When signs or barricades are erected giving
notice thereof, no person shall park a vehicle at any time upon any
of the driveways, exitways, roadways, parking lots or parking areas
or in areas the entrances to which have been barricaded.
Unless another penalty is expressly provided
by law, every person convicted of a violation of any provision of
this article shall be subject to a fine of not more than $50 or by
imprisonment for a period not exceeding 15 days, or both, in the discretion
of the Judge before whom conviction may be had.
