A. 
Voluntary restrictions which govern indoor conservation measures.
B. 
Mandatory restrictions. All residents, tenants and businesses of the Borough shall observe mandatory water use restrictions as follows:
(1) 
Outdoor use for lawn, garden, shrub, and any other vegetation watering, car and any other mobile equipment washing, and washing of driveways, sidewalks, buildings and equipment shall be restricted to alternate days, with usage allowed on even-numbered days for those residents or businesses whose dwelling, building or box number are even and on odd-numbered days for those residents or businesses whose dwelling, building or box number are odd. There shall be no such outdoor water usage on the 31st day of any month.
(2) 
Watering of lawns, gardens, shrubs and other vegetation shall be restricted to the hours from 6:00 a.m. to 9:00 a.m. and from 6:00 p.m. to 9:00 p.m.
In addition to the restrictions set forth in § 267-12 of this article, whenever the Borough Council shall be satisfied and finds that a water emergency exists in the Borough, it may adopt a resolution declaring that a water emergency exists in the Borough. Such resolution shall be adopted by the Borough Council at any regular, special, adjourned or emergency public meeting of the Borough Council. Such resolution shall specify which of the water use regulations contained in § 267-14 of this article is being imposed, as well as any exemptions as may be authorized. Such resolution shall be effective immediately upon publication according to law and shall continue in effect for 90 days, unless extended or repealed as set forth in § 267-15 of this article.
Upon adoption by the Borough Council of a resolution declaring that a water emergency exists in the Borough in accordance with § 267-13 of this article, all citizens shall be urged to observe voluntary indoor conservation measures, and any of the water use restrictions set forth herein shall be imposed and shall be applicable to all residents and tenants, except where a bona fide health emergency exists, as follows:

Outdoor use for lawn, garden, shrub, and any other vegetation watering, car and any other mobile equipment washing, and washing of driveways, sidewalks, buildings and equipment shall be restricted to the hours from 6:00 p.m. to 9:00 p.m.
B. 
Any other water use restriction specified by the Borough Council in the resolution required by § 267-13 of this article which is reasonable under the circumstances considering the nature and extent of the water emergency.
A. 
The resolution of the Borough Council required by § 267-13 of this article which declares a water emergency shall remain in effect for 90 days, as set forth in § 267-13, unless this period of time is extended or repealed by the Borough Council by resolution, but which shall be no longer than reasonably necessary to abate the water emergency as determined by the nature and extent of the water emergency.

B. 
At the expiration of the time period specified, the water use restriction shall lapse and be inapplicable and unenforceable.
C. 
If the Borough Council shall be satisfied that the water emergency has been abated prior to the expiration of the time period specified in the resolution or by declaration of the Borough Administrator, it shall adopt a resolution declaring the water emergency ended and the water use restrictions inapplicable.
D. 
If, at the expiration of the time period specified, the Borough Council shall be satisfied that the water emergency continues to exist, it may adopt a resolution in accordance with the requirements of this article continuing the water use restrictions.
A. 
The water use restrictions imposed pursuant to this article shall be enforced by the Police Department of the Borough of Chatham.
B. 
Whenever the Chatham Police Department shall find a violation of the water use restrictions, it shall give the violator a written warning and explain the penalties for continued offenses as provided by § 267-17 of this article.
C. 
The Chatham Police Department shall keep such records as may be reasonable and necessary for the purpose of determining the persons and businesses who have been warned upon a first offense. The Chatham Police Department is hereby empowered to write summonses for the violation of the water use restrictions imposed pursuant to this article.
After a first offense in accordance with any of the provisions of this article, any person who or business which thereafter violates the water use restrictions imposed pursuant to this article shall be punishable as provided in Chapter 1, § 1-14.

The use of fire hydrants for obtaining water shall be restricted to permitted uses approved by the Chatham Water Department or declaration of emergencies and exceptions by the Borough Council pursuant to Article III of Chapter 267, or as otherwise approved by the Borough Council. The following fees shall be paid to the Borough for any permitted use: $350 per use permit; $500 per eight-hour permit. All hydrant use should have an air gap upon fill ups and be supervised by the Chatham Water Department. Unless otherwise designated by the Borough Council, the only hydrant allowed and available for such service is located at the Department of Public Works complex.
