The public hearing upon an appeal or application
shall be held at the next regular meeting of the Board which is more
than nine days or 21 days, respectively, after the filing thereof.
Public hearings upon appeals or applications may also be held at special
meetings of the Board, properly called.
As soon as practicable after the filing of an
appeal or application and within the time prescribed, the Clerk shall
give or cause to be given the notices of hearing required by statute
and the ordinance.
The proceedings at each public hearing shall
be taken by a stenographer for the Board or recorded by reliable digital,
CD or tape method. The recording or stenographer notes shall not be
required to be transcribed except upon request of the Board or an
interested party. In the latter event, the charges for transcriptions,
at such rates as shall be approved by the Board, shall be paid by
the party, and the transcriber shall make an additional copy to be
filed with the records of the Board. If no request for transcription
has been made within 180 days after the written decision upon the
matter presented at the hearing has been filed with the Town Clerk,
the original notes or recorded equivalent may no longer be available
for transcription.
