For the purposes listed in §§ 236.01 and 236.45, Wisconsin Statutes, the Common Council ordains land division regulations as provided herein.
As used in this chapter, the following terms shall have the meanings indicated:
EXTRATERRITORIAL JURISDICTION AREA
The unincorporated area within 1 1/2 miles of the corporate limits of the City of Rice Lake.
LAND DIVISION
A subdivision, minor subdivision, other division, resubdivision, replat, condominium plat or parcel add-on.
MINOR SUBDIVISION
A division of a lot, parcel or tract of land by the owner thereof or the owner's agent for the purpose of transfer of ownership or building development, where the act of division creates 4 or fewer parcels or building sites, any of which is 5 acres or less in area. A minor subdivision is recorded with a certified survey map or a plat with the Barron County Register of Deeds.
OTHER DIVISION
A division of a lot, parcel or tract of land by the owner thereof or the owner's agent for the purpose of transfer of ownership or building development, where the act of division creates a parcel or parcels, or building site or sites, any of which is of 20 acres or less in area, and does not constitute a subdivision or minor subdivision. An other division is recorded with a certified survey map or a plat with the Barron County Register of Deeds.
SUBDIVIDER
Any person, partnership, corporation, or other entity creating a subdivision, minor subdivision, other division, resubdivision, replat, condominium plat or parcel add-on.
SUBDIVISION
A division of a lot, parcel or tract of land by the owner thereof or the owner's agent for the purpose of transfer of ownership or building development, where the act of division creates five or more parcels or building sites, any of which is five acres or less in area; or five or more parcels or building sites, any of which is five acres or less in area are created by successive divisions within a period of five years. Subdivision shall also include resubdivision and replatting. A subdivision is recorded with a plat with the Barron County Register of Deeds.
No division of land within the city or within its extraterritorial jurisdiction shall be permitted if it results in a subdivision, minor subdivision or other division unless a plat or a certified survey map of the land division is submitted and approved in accordance with this chapter and Chapter 236, Wisconsin Statutes. Condominium plats must be submitted and approved in accordance with this chapter and Chapter 703, Wisconsin Statutes.
In addition to the provisions of this chapter and Chapters 236 and 703, Wisconsin Statutes, all subdivisions, minor subdivisions, other divisions and condominium plats shall conform to Chapter 260, Zoning, Chapter 44, Official Map, and the Comprehensive Plan for the city and its extraterritorial planning area.
Whenever a tract to be divided embraces any part of an arterial, connector or collector street designated in the city's Comprehensive Plan or Chapter 44, Official Map, such part of the proposed public way shall be platted and dedicated by the subdivider at the location and a width indicated on the plan and in Chapter 44, Official Map. All street rights-of-way and utility easements required to serve the land division shall be dedicated by the subdivider.
No land shall be divided for residential use which is held by the City Plan Commission to be unsuitable for such use by reason of flooding or bad drainage, adverse earth or rock formation or topography or any other feature likely to be harmful to the health, safety or welfare of the future residents in the proposed land division or the community.
This chapter shall not repeal, impair or modify private covenants or public ordinances, except that it shall apply whenever the regulations it imposes are more restrictive.
This chapter, insofar as it may apply to divisions of less than five parcels, shall not apply to:
A. 
Transfers of interests in land pursuant to court order or by will, descent or survivorship;
B. 
Leases for a term not to exceed 10 years, mortgages or easements; and,
C. 
The sale or exchange of parcels of land between owners of adjoining property if additional lots are not thereby created and the lots resulting are not reduced below the minimum sizes required by Chapter 236, Wisconsin Statutes, or other applicable laws or ordinances.
