As used in this chapter, all words shall have their plain meaning as apparent from the language or context, and any word used herein which has been defined in N.J.S.A. 39:1-1 shall be so defined for the purposes of this chapter.
No omnibus shall load or discharge passengers at any location public or private, nor be parked on any premises either public or private, within the Borough of Clementon unless the registered owner of such vehicle shall have first obtained a permit of authorization from the Chief of Police of the Borough of Clementon or, in his absence, from the ranking police officer on duty.
A. 
Application for permit required under § 189-2 of this chapter shall be made at least 72 hours prior to the date desired for its use. Every applicant shall set forth in the application:
(1) 
Name and address of the applicant.
(2) 
Number of omnibuses desired to be parked, loaded and unloaded.
(3) 
Number of passengers desired to be loaded or unloaded.
(4) 
If any passengers are under the age of 21 years, the number of such underage passengers and the names and addresses of the adult chaperones of such underage passengers.
(5) 
The location within the Borough of Clementon where it is desired to load, unload or park.
(6) 
The date and time desired to load and unload or park.
B. 
Each application for a permit shall be accompanied by a filing fee of $2 payable to the Clerk of the Borough of Clementon.
A. 
Granting of the permit as required by § 189-2 of this chapter shall be solely within the discretion of the Chief of Police or, in his absence, the ranking police officer of the Borough of Clementon. Such determination shall be based upon the availability of sanitary facilities for the passengers, the availability of police protection, the availability of parking space, the availability of fire and emergency equipment and personnel, and the overall general welfare of the Borough of Clementon.
B. 
The Chief of Police or, in his absence, the ranking police officer of the Borough of Clementon, shall grant or deny every application for a permit under this chapter within 48 hours of the receipt of such application, and when such permit is issued it shall be signed by the Chief of Police of the Borough of Clementon or, in his absence, the ranking police officer on duty, and shall designate the time and place authorized to load, unload, and/or park.
This chapter shall in no way be construed as having any effect or be in any way applicable to:
A. 
Any omnibus operated along a prescribed route under the authority of the Public Utilities Commission of the State of New Jersey or the Interstate Commerce Commission of the United States of America.
B. 
Any school bus being operated by any school or school district actually transporting pupils to or from school or a school authorized activity.
C. 
Any vehicle or omnibus owned by or engaged by any church, summer school, bible school, or day camp, for use in the Borough of Clementon and adjacent communities to transport persons using the aforementioned institutions.
D. 
Any American Legion Group, Drum and Bugle Corps or other private club of the Borough of Clementon.
Upon conviction of the violation of any provision of this chapter, the violator shall be subject to a fine of not exceeding $50 and for imprisonment for a period of not exceeding 15 days or both, at the discretion of the court.
