[HISTORY: Adopted by the Mayor and Council of the Borough of Clementon 4-24-1978 by Ord. No. 78-4. Amendments noted where applicable.]
Provisions of this chapter, whether indicated in part or in whole, establish installation, construction, health and safety requirements for all swimming pools, whether private or public.
As used in this chapter, the following words shall have the meanings indicated:
PORTABLE POOL
Includes any swimming pool consisting of a watertight container open at the top; made of fabric, plastic or any other material and supported by a frame and resting on the ground; capable of being wholly or partially filled with water; and so constructed or erected that it may be taken apart. The term "portable swimming pool" shall further mean and include portable swimming pools capable of being filled to a water depth in excess of 24 inches, with access made by ladder, ramp, step or steps.
PRIVATE POOL
Includes swimming pools owned and operated by a private individual for use by his family and guests.
PUBLIC POOL
Includes swimming pools owned and operated either publicly or privately for use by the general public, community groups, social groups or multiple families.
SWIMMING POOL
Includes fill and draw, flow-through and recirculation pools, outdoor and indoor, which are artificially constructed to provide recreational facilities for swimming, bathing or wading and all buildings, equipment and appurtenances thereto. It shall not include naturally or artificially constructed outdoor ponds, rivers or lakes nor baths used for cleansing of the body or practice of the healing arts.
WADING POOL
Includes artificially constructed or erected swimming pools not designated or used for swimming, with a surface area of 250 square feet and a maximum water depth not to exceed 24 inches.
A. 
The installation, construction and maintenance of all swimming pools, except private wading pools, under the jurisdiction of this chapter shall comply with the requirements set forth in the 1975 BOCA Basic Building Code, Section 428.0. Specific requirements not otherwise covered within the BOCA Basic Building Code shall comply with the standards set forth in the 1970 Swimming Pool Code of New Jersey and/or certain other provisions set forth herewith.
B. 
All public swimming pools under the jurisdiction of this chapter shall meet safety and health provisions set forth in the 1970 Swimming Pool Code of New Jersey and certain other provisions set forth herewith.
C. 
All private swimming pools under the jurisdiction of this chapter shall meet safety and health provisions set forth herewith.
A. 
The duly appointed Construction Official of the Borough of Clementon has the jurisdiction to review plans and specifications and inspect all swimming pool installations under the jurisdiction of this chapter to ensure the proper arrangement and construction of all new or altered installations.
B. 
The Board of Health of Clementon has the administrative authority to ensure that all swimming pools under the jurisdiction of this chapter are in compliance with safety and health provisions of the 1970 Swimming Pool Code of New Jersey and other certain provisions set forth herewith.
C. 
The Camden County Board of Health serves as the authorized agency to inspect all public swimming pools to determine compliance with provisions set forth in the 1970 Swimming Pool Code of New Jersey.
A. 
All swimming pools constructed in the Borough of Clementon shall be of permanent waterproof construction. The water surface area of any such swimming pool shall not occupy more than 10% of the total lot area. The length of any such swimming pool shall be not greater than 2 1/2 times the width of such swimming pool, except as to swimming pools of other than rectangular shapes, in which case special provisions shall be made for scum removal.
B. 
The edge of such swimming pool shall be a minimum distance from the nearest property line at any point equal to 1 1/2 times the depth of the pool at its deepest point, but, in any event, such minimum distance shall be not less than five feet from said nearest property line. Such minimum distance shall be the shortest distance measurable from the property line to the nearest inside face of such swimming pool at its waterline.
C. 
No swimming pool shall have a bottom slab below groundwater level, unless special provisions are made for hydrostatic uplift.
D. 
No swimming pool, except a private wading pool, shall be constructed within 10 feet of the foundation wall of any dwelling, whether such dwelling be on the same premises on which the swimming pool is to be constructed or on adjacent premises.
All swimming pools, except private wading pools, shall conform to Section 3.14 of the 1970 Swimming Pool Code of New Jersey.
All wading pools shall be drained every night, unless such pool has a complete recirculating-purifying system in compliance with the 1970 Swimming Pool Code of New Jersey.
A. 
All ladders, stairs, ramps or steps must be removed and stored or otherwise secured as to ensure the safety of all small children when the pool is not in use and unattended by an adult.
B. 
In lieu of the required enclosure under § 253-6, all portable swimming pools may be equipped with a suitable strong cover, the specifications of which are that it shall hold 75 pounds and shall be put in place and locked at all times when the pool is unattended.
A. 
It shall be unlawful to construct, enlarge, alter, remove or demolish any nonportable swimming pool in the Borough of Clementon unless and until a permit for such purpose has first been secured from the Construction Official. There shall be paid to said Construction Official for a permit to construct a swimming pool a fee in the amount of $75 for residential and $125 for commercial.

B. 
There shall be paid to the Construction Official for a permit to enlarge or alter a swimming pool a fee in the amount of $25.
C. 
There shall be paid to the Construction Official for a permit to remove or demolish a swimming pool a fee of $10.
No swimming pool in violation of this chapter will be allowed to initiate or continue use and occupancy. The Board of Health and/or the Construction Official of the Borough of Clementon has the authority to order denial of use and occupancy of any swimming pool when a violation poses an immediate or potential threat to personal safety or health.
A. 
It shall be unlawful for a public swimming pool facility to be used and occupied in the Borough of Clementon unless and until a certificate for such purpose has first been secured from the Board of Health of the Borough of Clementon.
B. 
There shall be paid to said Board of Health for a certificate to use and occupy a public swimming pool a fee of $50. The certificate will remain valid for one year or until the certificate is revoked by the Board of Health of the Borough of Clementon due to violations of this chapter.
C. 
The loss of a use and occupancy certificate due to violations of this chapter will require a reinspection of the public swimming pool facility by the authorized agent and the obtainment of a new use and occupancy certificate from said Board of Health.
The owner and/or manager of any swimming pool facility in violation of this chapter who knowingly allows the use and occupancy of such a facility shall be subject to a fine of $100 and/or 30 days in jail.
The enforcement of the provisions of this chapter shall be the responsibility of the Police Department of the Borough of Clementon.
