Provisions of this chapter, whether indicated in part or in whole, establish
installation, construction, health and safety requirements for all swimming
pools, whether private or public.
As used in this chapter, the following words shall have the meanings
indicated:
PORTABLE POOL
Includes any swimming pool consisting of a watertight container open
at the top; made of fabric, plastic or any other material and supported by
a frame and resting on the ground; capable of being wholly or partially filled
with water; and so constructed or erected that it may be taken apart. The
term "portable swimming pool" shall further mean and include portable swimming
pools capable of being filled to a water depth in excess of 24 inches, with
access made by ladder, ramp, step or steps.
PRIVATE POOL
Includes swimming pools owned and operated by a private individual
for use by his family and guests.
PUBLIC POOL
Includes swimming pools owned and operated either publicly or privately
for use by the general public, community groups, social groups or multiple
families.
SWIMMING POOL
Includes fill and draw, flow-through and recirculation pools, outdoor
and indoor, which are artificially constructed to provide recreational facilities
for swimming, bathing or wading and all buildings, equipment and appurtenances
thereto. It shall not include naturally or artificially constructed outdoor
ponds, rivers or lakes nor baths used for cleansing of the body or practice
of the healing arts.
WADING POOL
Includes artificially constructed or erected swimming pools not designated
or used for swimming, with a surface area of 250 square feet and a maximum
water depth not to exceed 24 inches.
All swimming pools, except private wading pools, shall conform to Section
3.14 of the 1970 Swimming Pool Code of New Jersey.
All wading pools shall be drained every night, unless such pool has
a complete recirculating-purifying system in compliance with the 1970 Swimming
Pool Code of New Jersey.
No swimming pool in violation of this chapter will be allowed to initiate
or continue use and occupancy. The Board of Health and/or the Construction
Official of the Borough of Clementon has the authority to order denial of
use and occupancy of any swimming pool when a violation poses an immediate
or potential threat to personal safety or health.
The owner and/or manager of any swimming pool facility in violation
of this chapter who knowingly allows the use and occupancy of
such a facility shall be subject to a fine of $100 and/or 30 days in jail.
The enforcement of the provisions of this chapter shall be the responsibility
of the Police Department of the Borough of Clementon.
