No person shall present a play, production or performance in the Township
of Lebanon without first obtaining a license from the Chief of Police as hereinafter
provided.
Such license shall be issued by the Chief of Police upon the filing
of a written, signed application with the Chief of Police and payment of both
an annual license fee and the fee relating to performances on specified dates.
The application for license shall state the location of the premises
and buildings (if any) which will be used for the presentation; its parcel
and block number as the location appears on a specified sheet of the Lebanon
Township Tax Map together with a drawing on such sheet of the Tax Map showing
the public roads which give access to the premises sought to be licensed and
the location of the parking facilities.
The application shall give a list of the dates desired by the applicant
and the number of performances planned for each date, together with the hour
of planned start, estimated completion of each performance and estimated attendance
for each performance. Applicant shall notify in writing the Chief of Police
as to the number of persons in attendance at each performance within a reasonable
time thereafter.
The applicant shall pay an annual license fee upon the filing of the application. The license fee is included in Chapter
205, Article
II, Fee Schedule. Such license shall expire on December 31 of the applicable year.
The applicant shall also pay to the Chief of Police for the use of the
Township a fee equal to the estimated cost of police and public highway traffic
control for the number of police-hours required for each performance as estimated
by the Chief of Police, at a rate per police-hour as determined annually by
the Township Committee by resolution.
Plays, productions or performances given by schools or by religious,
charitable or nonprofit organizations shall be exempt from the payment of
fees under this chapter. However, this chapter shall be otherwise applicable
to such parties, and license applications shall be filed by them.
The grant of a license under this chapter shall not be construed to constitute a waiver of any provision of Chapter
400, Zoning, or any other ordinance of the Township, or of any rule or provision of the laws of the State of New Jersey or any applicable political subdivision thereof.
The penalty for the violation of this chapter shall be as established in Chapter
1, Article
II, General Penalty, for each performance for which a municipal license was not issued.
The Chief of Police shall forthwith transmit all funds collected by
him to the Township Clerk.
