Whenever Dravosburg Volunteer Fire Department No. 1, Dravosburg Volunteer Fire Company No. 2, and the Dravosburg Police Department respond to fire calls and/or fire alarms at sites within the Borough of Dravosburg, or outside the Borough of Dravosburg in response to calls for mutual aid from a neighboring municipality, the owners of property at which fires occur shall be responsible for payment to Dravosburg Volunteer Fire Department No. 1, Dravosburg Volunteer Fire Company No. 2, and the Dravosburg Police Department for all damage or loss to property or equipment suffered by the Dravosburg Police Department, Dravosburg Volunteer Fire Department No. 1, Dravosburg Volunteer Fire Company No. 2, and the Dravosburg Police Department in responding to such fire calls and/or fire alarms.
Whenever the Dravosburg Police Department responds to fire calls and/or fire alarms at sites within the Borough of Dravosburg, or outside the Borough of Dravosburg in response to calls for mutual aid from a neighboring municipality, the owners of property at which fires occur shall be responsible for payment to the Borough of Dravosburg for all wages paid to Dravosburg police officers who respond to such fire calls and/or fire alarms and are executing their duties to protect the health, safety and welfare of the community.

The Borough of Dravosburg hereby designates Dravosburg Volunteer Fire Department No. 1 as the only primary fire and emergency response unit within the Borough of Dravosburg, and further confirms and acknowledges that Dravosburg Volunteer Fire Department No. 1 has been the only primary fire and emergency response unit in the Borough of Dravosburg for a significant period of time prior to the enactment date of this section.

The Borough of Dravosburg hereby imposes reasonable fire and emergency fees to defray the cost of all fire and emergency equipment and materials utilized by Dravosburg Volunteer Fire Department No. 1 in responding to fires or other emergencies, whether inside or outside the municipal boundaries of the Borough of Dravosburg. Such fees shall be in accordance with a schedule of fire and emergency fees set by the Dravosburg Volunteer Fire Department No. 1 for equipment and material usage.

The Borough of Dravosburg hereby imposes hazardous material fees for hazardous material cleanup, landslides or cleanup due to natural or man-made forces, and which result in the response of any fire, hazardous material (hazmat), ambulance or any other public emergency response vehicles inside the municipal boundaries of the Borough of Dravosburg. Such fees shall be billed at a minimum of $500, plus $50 per hour, plus cost for the cleanup materials, plus 20% of the cost of materials, by any volunteer fire, hazardous material (hazmat), ambulance or any other public emergency response agencies responding to such call for hazardous material cleanup in the Borough of Dravosburg.

The Borough of Dravosburg hereby imposes standby response fees for fire, ambulance and/or emergency medical services, whether inside or outside the municipal boundaries of the Borough of Dravosburg, for utility services interruptions which include, but are not limited to, service interruption or breaks in electrical line, telephone line, cable line, utility pole, light standard pipe line breaks or leaks, or any other exigency which requires the fire and/or ambulance company to stand by while the utility company, cablevision company, or any other entity that utilizes a pipeline, gas line, electric lines, telephone poles or light standards makes repairs. Such fees shall be as set from time to time by resolution of the Borough Council. If the standby response occurs at multiple locations, then the aforesaid fee is applicable at each location.

Dravosburg Volunteer Fire Department No. 1, or a third-party collection agency on behalf of Dravosburg Volunteer Fire Department No. 1, shall request and collect all fees for fire, ambulance, prevention and safety protection services and for other emergency services. Such fees may include and encompass all cost for manpower, equipment, materials, maintenance and overhead expenses.

The Borough may enforce the provisions of this article by civil action in a court of competent jurisdiction for the collection of any amounts due hereunder, plus attorneys' fees, and for any other relief that may be appropriate, including equitable relief.
The fees heretofore set forth are not inclusive of all the remedies that the Borough or its volunteer fire or ambulance companies may pursue. The Borough of Dravosburg or its volunteer fire or ambulance companies, their agents, officials, employees or members have the right to pursue any other legal remedy or to recover any other cost against any person regardless of payment of the prescribed fees.
