Western Pennsylvania Water Company is hereby authorized and directed,
at the request of the Borough of Dravosburg, to shut off the supply of water
to the owner or occupant of any premises served by Western Pennsylvania Water
Company if such owner or occupant shall neglect or fail to pay, for a period
of 30 days from the due date thereof, any rental, rate or charge for sewer,
sewage or sewage treatment service imposed by the Borough of Dravosburg, and
the water shutoff shall remain until all such overdue rentals, rates and charges,
together with any penalties and interest thereon, shall be paid in full to
the Borough of Dravosburg.
Prior to shutting off the water supply to the owner or occupant of premises
served by Western Pennsylvania Water Company as provided for under the terms
of this chapter, the Borough of Dravosburg shall provide at least 10 days'
notice by mail of an intention to shut off the supply of water to the owner
or occupant of such premises, and, in addition thereto, the Borough of Dravosburg
shall provide a written notice at the main entrance to the premises. If, during
such ten-day period, the person liable for the payment of the rentals and
charges delivers to the Borough of Dravosburg or Western Pennsylvania Water
Company a written statement, under oath or affirmation, stating that he has
a just defense to the claim, or part of it, for such rentals or charges, and
that the statement is not executed for the purpose of delay, then the water
supply shall not be shut off until the claim has been judicially determined.
Any owner or occupant of premises served by Western Pennsylvania Water
Company whose supply of water is shut off as provided for under the terms
of this chapter shall pay to the Borough of Dravosburg all costs associated
with such water shutoff, including, but not limited to, any costs imposed
upon the Borough of Dravosburg by Western Pennsylvania Water Company for the
water shutoff, any costs imposed upon the Borough of Dravosburg by Western
Pennsylvania Water Company for the loss of water rentals during the length
of the shutoff, and any administrative costs incurred by and/or imposed by
the Borough of Dravosburg for posting and mailing of necessary legal notices
attendant with such water shutoff.
The appropriate officers of the Borough of Dravosburg are hereby authorized
and directed to execute a proposed agreement with Western Pennsylvania Water
Company to accomplish the purposes specified in this chapter, which agreement
shall be identical in form and content to attached Exhibit A hereto.
