[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
It is the policy of the Borough of Dravosburg to protect the health, safety and welfare of the citizens using the sidewalks of the Borough. To guard the safety of all citizens using the public sidewalks, the following regulations and penalties are adopted. This policy shall apply to all sidewalks presently situated in the Borough and any sidewalks constructed in the Borough in the future.
The following definitions shall apply in the interpretation and enforcement of this article:
BUSINESS DAY
Any day except Sundays and national holidays.
ROADWAY
That portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder.
SIDEWALK
That portion of a street between the curblines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians.
STREET or HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
Every person, partnership, corporation, joint stock company, or syndicate in charge or control of any building, structure or lot of land within the Borough limits fronting or abutting on a paved sidewalk constructed of concrete, brick, stone or other material, whether as owner, tenant, occupant, lessee, or otherwise, shall remove and clear away, or cause to be removed and cleared away, all snow, sleet and ice on said sidewalk as is in front of or abutting on said building, structure, or lot of land within 24 business-day hours after the ceasing to fall of any snow, sleet or ice or the accumulation of ice caused by freezing after nightfall or for any reason of nature whatsoever.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 and costs, or, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days.
