[HISTORY: Adopted by the Mayor and Council of the Borough of Closter 11-22-1967 by Ord. No. 1967:179 as Ch. 18 of the 1967 Code. Amendments noted where applicable.]
There is hereby created and established in and for the Borough of Closter, in the County of Bergen and State of New Jersey, a Board of Assessment, pursuant to N.J.S.A. 40:56-22 et seq., the amendments thereto and supplements thereof, to make all assessments for benefits accruing from local improvements under Chapter 56 of Title 40 of the Revised Statutes of the State of New Jersey. Said Board shall be known as the "Assessment Board of the Borough of Closter" and shall consist of three (3) members to be appointed as hereinafter in this chapter provided.

The Assessment Board created and established by § 5-1 of this chapter shall have all the powers to make assessments for benefits accruing for local improvements under Chapter 56 of Title 40 of the Revised Statutes of the State of New Jersey, pursuant to and as provided in N.J.S.A. 40:56-21 et seq., the amendments thereto and supplements thereof, and said Board shall be subject to all restrictions and regulations and the performance of all duties provided in said statutes.
The members of the Assessment Board created and established by this chapter shall be appointed pursuant to and in accordance with the procedures provided in N.J.S.A. 40A:60-1 et seq. Such members shall be discreet freeholders and residents of the Borough of Closter.

The term of each member of said Assessment Board shall be for one (1) year, commencing January 1 of the year in which he or she is appointed, and until his or her successor shall have qualified. Notwithstanding the preceding sentence, the members of said Board at the time that the cost of a local improvement is certified to said Board pursuant to N.J.S.A. 40:56-24 shall, if not otherwise disqualified, remain the Assessment Board for making the assessments with respect to any such local improvement until final action with respect thereto has been taken by the Borough Council of the Borough of Closter. All vacancies shall be filled in the manner of original appointments for the unexpired term only.
A member of said Assessment Board shall in no way be interested in any local improvement for which said Board is to make assessments. In the event that any member of said Board is disqualified from acting with respect to a particular local improvement by reason of his or her interest therein, some other suitable person shall be appointed in the manner provided in § 5-3 of this chapter for making the assessments with respect to such local improvement.
The members of said Assessment Board shall receive such reasonable compensation for their services as the Borough Council of the Borough of Closter may, by resolution, fix and determine and upon the presentation of proper vouchers therefor. In determining the amount of any such compensation, the Borough Council shall consider the nature of the local improvement for which assessments have been made, the complexity of making such assessments, the hearings held by said Board, the time spent in viewing the lands and premises involved and any other factors as relate to the nature and extent of the services performed by the members of said Board.
