No person shall detain or fail to return any book, periodical, pamphlet,
artistic representation, phonograph recording, audiovisual material or any
article borrowed from the library on a card issued by the library (hereinafter
referred to as "library card") contrary to the rules and regulations of said
library or a member library of the Bergen County Cooperative System (herein
referred to as "member library") after delinquency notices have been issued
and after thirty (30) days have elapsed since the date of posting by certified
mail, return receipt requested, of a final notice demanding return thereof,
addressed to said person at the last address furnished to the library.
No person shall willfully or maliciously cut, tear, deface, disfigure,
damage or otherwise destroy any book, periodical, pamphlet, artistic reproduction,
phonograph recording, audiovisual material or any other article or any part
thereof which is owned by or in the custody of or is borrowed from the library
or a member library.
No person shall remove any book, periodical, pamphlet, artistic reproduction,
phonograph recording, audiovisual material or any other item from the library
building without complying with the rules, regulations and procedures of said
library for borrowing such items or articles.
No person with intent to defraud shall register or furnish a false name
or address or use any other library card other than the one issued to said
person for the purpose of borrowing any book or other material from the library
or member library.
The Library Director is authorized to file a complaint against any person
violating this chapter in the Municipal Court or any other court of competent
jurisdiction under the following conditions:
A. A violation of any of the provisions of this chapter;
B. A certified letter, return receipt requested, has been
sent by the library administration as a final notice after six (6) weeks has
elapsed since the original date due, informing the borrower that unless the
material is returned or, if lost, paid for or fines paid within thirty (30)
days, a summons will be issued under the provisions of this chapter; or
C. In the case of minors, the letter or complaint shall
be directed to the parents or guardians of the minor involved.
Any person who violates or refuses to comply with the provisions of this chapter shall, upon conviction thereof, be subject to a penalty as set forth in Chapter
1, General Provisions, Article
II, Violations and Penalties, of this Code.
