The Mayor and Council of the Borough of Closter,
New Jersey, deem it necessary to the public interest, health, safety,
comfort, convenience, protection of property values and the general
welfare of the Borough of Closter to provide a mechanism whereby developers
of property which are subject to minimum off-street parking obligations
but, due to the unique character of the subject property or other
factors, are granted site plan approval or variances providing for
less than the otherwise mandated number of parking spaces may be required
to contribute to a fund dedicated to the acquisition, construction
and maintenance of municipal parking areas.

A. There is created within the Borough of Closter a Closter
Parking Reserve, which shall be set aside and be available for the
acquisition, creation and maintenance of municipally owned, controlled
or maintained parking areas.
B. The Closter Parking Reserve shall be overseen and
managed by the Borough Administrator, a member of the Council and
the Borough Zoning Officer.
C. The Closter Parking Reserve shall be established and
funded from monies to be paid by applicants for the development of
real property that are required by either the Planning Board or Zoning
Board of Adjustment of the Borough of Closter to pay to the Borough
a sum to be determined by the Borough Engineer on or about January
1 of each year, for the difference between the number of parking spaces
approved for the development and the minimum number of parking spaces
otherwise required by the Zoning Ordinances of the Borough of Closter.
D. Where the number of off-street parking spaces required
by the zoning ordinances of the Borough of Closter is more than the
number of off-street parking spaces proposed by any applicant, the
Planning Board of the Borough of Closter and/or the Zoning Board of
Adjustment of the Borough of Closter are authorized to impose, as
a condition of any approval of such application, that the applicant
pay to the Borough of Closter the sum provided for each such space
that is less than the minimum number required by the Zoning Ordinance.

If any sentence, section, clause or other portion of this Part
6 or the application thereof to any person or circumstance shall for any reason be adjudged by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair or repeal the remainder of this Part
6.
All ordinances or parts thereof inconsistent
herewith are hereby repealed to the extent of such inconsistency.
This Part
6 shall take effect immediately upon final passage and publication as required by law.
