A. 
The Falls Township swimming pool regulations are hereby created by adopting the BOCA National Building Code/1993, Section 421.0, Swimming Pools, of the Building Officials and Code Administrators International, Inc. (hereinafter referred to as "BOCA"). The BOCA National Building Code is incorporated herein by reference.
B. 
The requirements of the BOCA Swimming Pool Code herein adopted shall be mandatory, and the words "shall" and "should" appearing in said code are to be interpreted as being mandatory as opposed to being permissive or optional.
In case any private swimming pool or similar artificial water area is used, occupied or maintained in violation of this chapter, the Board of Supervisors, in addition to the remedies herein otherwise provided for, may institute any appropriate action or proceeding to prevent, restrain, correct or abate such unlawful use, maintenance or occupancy, or prevent any act or to correct any condition that is contrary to or illegal under this chapter.
Nothing herein contained shall be deemed to reduce, limit or remove any of the power or authority of the Building Inspector. This chapter shall be construed to be supplementary to all other pertinent ordinances now in effect unless the provisions of such other ordinance or ordinances are directly in conflict herewith or less stringent than similar provisions of this chapter.

Any person who violates or permits a violation of this chapter shall be guilty of a summary violation and, upon conviction, shall be sentenced to pay a fine of not more than $1,000, plus all court costs, including reasonable attorney's fees, incurred by the township in the enforcement of this chapter. Each day a violation exists shall constitute a separate offense. In default of the payment of any fine, the defendant shall be sentenced to imprisonment to the extent allowed by law for the punishment of summary offenses. Further, the appropriate officers or agents of the township are hereby authorized to file a citation for such summary violation and seek any other available relief at law or equity, including injunction, to enforce compliance with this chapter.
