The Council will appoint a Municipal Clerk for
the term of three years or until the appointment and qualification
of his successor. Prior to his appointment, he shall have been qualified
by his training and experience to perform the duties of his office.
He shall serve as Clerk of the Council and have such other functions,
powers and duties as are provided for by the Charter and this code.
The Municipal Clerk shall:
A. Keep the minutes and records of the proceedings of
the Council and of the proceedings of any Council committee upon request
of the Chairman of the committee.
B. Preserve and compile all ordinances and resolutions
and, at the close of each year with the advice and assistance of the
Township Solicitor, the Clerk shall compile, codify and bind all the
ordinances and resolutions then in effect and shall properly index
such compilation or codification and provide for its publication.

C. Have and take custody of all the official books, papers
and documents of the municipality for which no other repository is
provided by the Charter or ordinance and preserve and keep them safely.
D. Provide secretarial and clerical services for the
Councilmen in the discharge of their official duties.
The Clerk shall cause the Municipal Seal to
be affixed to instruments and writings when specifically authorized
by law or when necessary to exemplify any document or record in his
office, or to certify an act on paper which, from the records of his
office, shall appear to be a true copy of any public record proceeding.
He shall not affix the Seal or cause or permit it to be affixed to
any instrument or writing or other paper except as provided in this
section, unless required by law.
The Clerk shall publish ordinances as required
by law and shall file in his office the requisite proofs of such publications.

The Clerk shall issue and deliver, with the
assistance of the Division of Police, if needed, all notices of meetings
required to be given to the Council and shall promptly inform the
members of the Council of action taken by the Mayor with respect to
any ordinances.

The Clerk shall administer licenses pursuant
to the ordinances and general law. The Division of Police shall assist
in the inspection and enforcement procedures required for such licensing.
In addition to the general licensing authority enumerated herein,
the Township Clerk may further perform the duties of the issuing authority
for the approval and/or granting of bingo and raffle licenses pursuant
to N.J.A.C. 13:47-1.1 et seq.
The Clerk shall receive and transmit all communications
to or on behalf of the Council.
The Clerk shall charge and receive for the use
of the municipality such fees for searches, transcripts and certifications
as shall be authorized by resolution or ordinance of the Council or
by state statute.
The Clerk shall also:
A. Perform all the functions required of municipal clerks
by the general election law and any other law or ordinance and receive
for municipal use the fees prescribed therefor.
B. Perform such functions as are vested in the Municipal
Clerk by state law and ordinances relating to bingo and raffles licensing.
C. Have such other, different and additional functions,
powers and duties as may be prescribed by law, ordinance or resolution.
The Clerk shall be the depository and custodian
of all official surety bonds furnished by or on account of any Township
office, officer or employee, except his own bond which shall be placed
in the custody of the Township Treasurer, and all formal contracts
for work, labor, services, supplies, equipment and materials to which
the Township may be a party. The Clerk shall also have custody of
all leases of property owned by the Township and shall keep an acquired
property list of all Township-owned properties. The Clerk shall be
the depository for and have custody of all performance bonds running
to the Township as obligee and other forms of security given by any
contractor, subdivision developer or other persons on account of work
done or to be done in or for the Township.

A. Pursuant to N.J.S.A. 40A:9-135, there is hereby created
the position of Deputy Municipal Clerk. The Deputy Municipal Clerk
shall be appointed by Council for a term not to exceed three years
or until the appointment and qualification of his/her successor. Upon
the successful appointment and qualification of two consecutive three-year
terms, the Deputy Municipal Clerk shall obtain tenured status and
obtain all of the rights and protections afforded to the Municipal
Clerk as established in the relevant state statute.
B. In the absence of the Municipal Clerk, the Deputy
Municipal Clerk shall have all the powers of the Municipal Clerk and
shall perform the functions and duties of the office.

The Clerk, or other person so designated, is
the official who shall prepare and issue certificates as to the approval
of a subdivision of land pursuant to law (N.J.S.A. 40:55D-56). Prior
to the issuance of any approval, he shall ascertain from the records
of the Planning Board, Township Engineer, Board of Adjustment, Township
Solicitor and otherwise, as well as from the records in the office
of the Clerk, the status of the subdivision in question.
Correspondence and other communications received
shall be delivered to the Clerk's office, where it shall be sorted
and delivered immediately to the proper department without opening
where the address is to a specific department or person. General municipal
mail and mail addressed to the Council shall be opened in the Clerk's
office, and the Clerk shall either reply to the correspondence and
provide information requested or shall refer the matter to the appropriate
individual, department, board or body.

The Clerk shall cause to be mailed or distributed
to the Council, Mayor, Township Solicitor and Township Engineer a
copy of the minutes of every regular and special Council meeting.
