This article shall be entitled "Peddlers, Hawkers,
Vendors, Solicitors, Canvassers and Seasonal Sales Vendors."

The purpose and intent of this article is to establish regulations
relative to intermittent, temporary and part-time sales of goods and
merchandise. This article is also to establish regulations during
specific "seasonal time periods" defined as Christmas, Valentine's
Day, Easter and Mother's Day, and to prohibit seasonal sales
in all residential-zoned classifications as set forth in the Zoning
Code of the Township of Waterford. This article also prohibits stationary vendors from selling
merchandise and goods outdoors without receiving required Planning/Zoning
approval or obtaining a permit from the Township Clerk. This article
shall set forth the application/approval process for licensing for
peddlers, hawkers, vendors, solicitors, canvassers, transient merchants
and seasonal sales. Furthermore, this article is to preserve Township
aesthetics and zoning, alleviate traffic congestion, protect against
pedestrian and motor vehicle accidents and generally protect the health,
safety and welfare of the public of the Township of Waterford.
As used in this article, the following terms
shall have the meanings indicated:
MERCHANDISE (PEDDLER, HAWKER, VENDOR, SOLICITOR or CANVASSER)
This definition shall include all goods, wares, foods, fruits,
vegetables, farm products, books, magazines, periodicals, printed
materials, arts, crafts, orders or contracts for services, home improvements
or alterations and anything that may be sold or distributed by peddlers
or solicitors and all kinds of articles or personal property for personal
and/or domestic use.

MERCHANDISE (SEASONAL SALES)
This definition shall only include Christmas trees, Christmas
wreaths, Christmas grave blankets, Christmas arts and crafts, valentine
flowers, Easter flowers, Easter baskets, Mother's Day flowers, Mother's
Day baskets and other articles of arts and crafts related to the seasonal
sales activity of these specific days.
NONPROFIT SEASONAL SALES VENDORS and NON-PROFIT-MAKING VENDORS
Any nonprofit, religious, charitable, educational, civic
or veteran organization, society, association, service, club, volunteer
first aid organization or fire company which is located within the
boundaries of the Township of Waterford and sells goods and merchandise
at a specific location, either owned by the nonprofit organization
or at a location not owned by the nonprofit organization, having the
written consent of the owners of property to conduct seasonal sales
activities within the Township of Waterford.

PEDDLER, HAWKER AND VENDOR
Any person, whether or not a resident of the Township of
Waterford, traveling about and through the Township of Waterford,
either on foot, by vehicle or by any manner, means or method, who
shall go from house to house, place to place or street to street,
conveying or transporting goods, products, wares, merchandise, food
or drink or any product thereof, offering or exposing the same for
sale or making sales and delivering articles to purchasers, or who
engages in any of the foregoing activities from a stationary location
on the street or other public place.
PERSON
Any individual, partnership, partner, corporation or corporations
or similar business entity.
SEASONAL SALES TIME PERIOD
This shall be defined as a specific time period to sell goods
and/or merchandise as follows:
A.
CHRISTMAS- A time period not to exceed 30 days, including Christmas Day and 29 days preceding Christmas Day.
B.
VALENTINE'S DAY- A time period not to exceed five days, including Valentine's Day and the four days preceding Valentine's Day.
C.
EASTER- A time period not to exceed five days, including Easter and the four days preceding Easter.
D.
MOTHER'S DAY- A time period not to exceed five days, including Mother's Day and the four days preceding Mother's Day.
SEASONAL SALES VENDOR
A person who sells goods and/or merchandise for a specified,
limited purpose and period of time, at a location owned by and/or
leased by the person.
SOLICITOR OR CANVASSER
Any person, whether or not a resident of the Township of
Waterford, who goes from house to house, from place to place or from
street to street, whether on foot or by conveyance of any kind, nature
or sort, soliciting, taking or attempting to take orders for the sale
of services, goods, wares, merchandise, food or drink or any products
thereof, or property of any kind or nature whatsoever, for future
performance or delivery, whether or not such individual has, carries
or exposes for sale a sample of the subject of such order, and whether
or not he is collecting advance payments on such sales or orders,
or who engages in any of the foregoing activities, from a stationary
location on the street or other public place.
TRANSIENT MERCHANTS
Includes the terms "itinerant merchant" and "itinerant vendor"
and shall mean any person who engages in a temporary business of selling
articles of value within the Township of Waterford and who, in furtherance
of such purposes, hires, leases, uses or occupies any building, structure,
motor vehicle, tent, railroad boxcar, boat, public rooms and hotels,
lodging houses, apartments, shops or any street, alley or other public
place within the Township for the exhibition and sales of such articles
of value, either privately or at public auction.

A. No peddler, hawker, canvasser, solicitor, transient merchant or vendor
shall sell or offer for sale to the general public any goods or merchandise,
beverages or food products from a fixed location utilizing public
or quasi-public streets and sidewalks within the Township of Waterford.
In addition, the sale of merchandise and goods from stationary locations
is prohibited, with the exception of seasonal sales licensed under
this article and transient merchants in compliance with this chapter.
A person shall be deemed to be selling from a fixed location if such
person remains at a fixed location for a period of 15 minutes or longer,
unless extended as provided below.
B. Extension.
(1) The fifteen-minute time limitation is extended beyond 15 minutes,
but not to exceed 30 minutes in total, for such periods of time that
customers or prospective customers are being serviced by the vendor
wherein the customers or prospective customers are:
(a)
Examining, viewing, handling, testing, pricing
or returning the merchandise;
(b)
Seeking information from the person;
(c)
Making purchases or sales; and/or
(d)
Waiting to be attended by the person.
(2) The fifteen-minute time limitation is further extended
for such time following a sale or purchase that the person may need
to replace or replenish merchandise, to perform that which is necessary
to clean, straighten up the cart or its merchandise, to secure the
proceeds of the sale, to file copies of receipts and/or other acts
that occur following the sale of such merchandise. However, the total
time allotted for such acts following a sale under this subsection
shall not exceed 10 minutes.
(3) At the expiration of the 15 minutes plus the extended
period as provided above, the person must move from such location
to a location at least 25 feet away. Such person cannot return to
within 25 feet of such location for a period of at least one hour.
No person has a right to any particular location on the public right-of-way
and/or sidewalks.

It shall be unlawful for any hawker, peddler,
vendor, solicitor, canvasser, seasonal sales vendor and transient
merchant, as defined herein, to engage in such activity within the
Township of Waterford without first obtaining a license therefor,
in accordance with the provisions of this article.

Applicants for a license under this article
shall file with the Township Clerk an application, in duplicate, on
forms to be provided by the Township Clerk, that shall provide the
following information, all of which shall be sworn to:
A. The name, address and telephone number of the organization
and/or business applying for a license under the provisions of this
section.
B. The name, address, telephone number and description of those individuals
to be employed and engaged in peddling, hawking, soliciting, canvassing
or being a transient merchant.

C. The place or places of residence of the organization and/or business
applying for a license, as well as those individuals engaged by the
organization and/or business in conducting peddling, hawking, vending,
soliciting, canvassing activities and being a transient merchant.

D. The social security numbers and driver license numbers of individuals
of the organization and/or business engaged in the activities of peddling,
hawking, vending, soliciting, canvassing or being a transient merchant.

E. The social security numbers and driver license numbers of those individuals
engaged in peddling, hawking, vending, soliciting, canvassing and
acting as a transient merchant for the organization and/or business
applying for a license to conduct said activities.

F. A brief description of the nature of the business,
the goods to be sold and the name and addresses of the principal office
of their manufacturer as well as the name and address of the agent
designated to receive service of process in the State of New Jersey
of said organization and/or business applying for a license under
this article.
G. The length of time for which the right to do business
is desired by the organization and/or business applying for the license.
H. A photograph of the individuals employed by the organization
and/or the business applying for a license, taken within 60 days immediately
prior to the filing of the application.
I. Three business references located in the County of Camden, State
of New Jersey, or in lieu thereof, such other available evidence of
the character and business responsibility of the applicant as will
enable an investigator to properly evaluate such character and responsibility.
J. A statement as to the individuals employed by the
organization and/or business applying for a license indicating whether
or not those individuals have been convicted of any crime, disorderly
persons offense or violation of any municipal ordinance, as well as
describing the nature of the events and the punishment or penalty
assessed therefor.
K. Whether or not orders are to be solicited or taken
for future delivery of goods or performance of services by the organization
and/or business applying for a license.
L. The fingerprints of the person applying for the business registration
certificate and of all employees employed by applicant who will be
performing the service within the Township.
M. The applicant being the organization and/or business
applying for a license shall list previous licenses issued by the
Township of Waterford as well as other municipalities wherein licenses
have been applied for and issued by those municipalities.
N. Proof of registration with the New Jersey Division
of Taxation and copy of a valid certificate of authority to collect
sales taxes.
O. The time of soliciting, peddling, hawking, vendoring and canvassing
shall be between the hours of 9:00 a.m. and 7:00 p.m., Monday through
Saturday.
(1) The aforesaid time limitation shall apply to all persons issued a
license identified on the application unless such a person or license
holder has been invited to a dwelling by an occupant of said dwelling,
or had previously made an appointment with the applicant of the dwelling.
When the sale or attempted sale of the merchandise is not involved,
and canvassing and soliciting is in connection with a political campaign
or charitable or religious organization recognized as tax exempt under
the United States Internal Revenue Service, solicitation may take
place from 9:00 a.m. to 7:00 p.m., Monday through Sunday, unless other
prior arrangements have been made with the occupant of the dwelling.
Applicants for a license under this article
shall file a sworn application with the Township Clerk, in duplicate.
Complete applications for seasonal sales license must be submitted
20 days prior to the actual specified time period for conducting a
seasonal sales activity. An application determined to be incomplete
upon review shall be returned to the applicant. In addition, the following
information shall be required and sworn to:
A. The name, address and telephone number of the organization
and/or business applying for a license under the provisions of this
section.
B. The name, address, telephone number and description
of those individuals to be employed by and engaged in a seasonal sales
activity.
C. The block and lot location of the property to be utilized
in conducting a seasonal sales activity.
D. The social security numbers and driver's license numbers
of individuals of the organization and/or business engaged in the
seasonal sales.
E. The social security numbers and driver's license numbers
of individuals engaged in seasonal sales for the organization and/or
business applying for a license to conduct said activities.
F. The length of time for which the right to do business is desired by the organization and/or business applying for the license as per §
208-3 of this article, which defines seasonal sales period.
G. A photograph of the individuals employed by the organization
and/or the business applying for a license, taken within 60 days immediately
prior to the filing of the application.
H. The individuals employed by the organization and/or
business applying for a license shall be fingerprinted at the request
of the Chief of Police.
I. A statement as to the individuals employed by the
organization and/or business applying for a license indicating whether
or not those individuals have been convicted of any crime, disorderly
persons offense or violation of any municipal ordinance, as well as
describing the nature of the events and the punishment or penalty
assessed therefor.
J. The applicant being the organization and/or business
applying for a license shall list previous licenses issued by the
Township wherein licenses have been applied for and issued by those
municipalities.
K. The time of seasonal sales shall be between the hours
of 9:00 a.m. and 9:00 p.m.
L. A property survey of the lot(s) to be prepared by
a New Jersey licensed professional engineer or surveyor. A hand-drawn
sketch plat may be substituted in lieu of a survey plat as determined
by the Township Clerk. The purpose of the survey plat and/or sketch
plat is to determine if the proposed use of the property location
is sufficient for the intended purpose of conducting seasonal sales.
The following information must be set forth on the survey and/or sketch
plat submitted:
(1) The location of and quantities of merchandise to be
stored and displayed on the lot(s).
(2) The location of on site parking, as well as off-site
parking associated with the site location.
M. The location of curb cut access to indicate proper
ingress and egress to the site to evaluate and prevent traffic hazards,
congestion or excessive interference with normal traffic movements
on adjacent public streets.
N. The location of temporary signs in accordance with
regulations set forth in the Zoning Code of Township of Waterford.
O. No temporary signs advertising the seasonal sales
activity shall be place on any tree, telegraph, electric light or
public utility pole or upon rocks or other natural features located
within the public right-of-way. All temporary signs shall be located
on the site.
P. No more than four temporary signs shall be created.
Temporary signs shall not exceed six square feet in area nor exceed
four feet in height.
Q. Temporary signs may not be erected prior to 48 hours
of the designated seasonal sales activity and must be removed within
48 hours after the time period stated and licensed for conducting
a seasonal sales activity.
R. No sign shall be erected that is of such character,
form, shape or color that it imitates or resembles any official traffic
sign, signal or device, or that has any characteristics which are
likely to confuse or dangerously distract the attention of the operator
of a motor vehicle on a public street.
S. Temporary signs shall be kept in a proper state of
repair, in accordance with the requirements of the Township's Building
Code, Property Maintenance Code, and other pertinent regulations. Signs which fall into such a state of disrepair as to
become unsightly or to pose a threat to public safety may be removed
by the Township at the owner's expense upon proper notification by
the Township.
T. No temporary sign shall be erected within or project
over the right-of-way of any public street or sidewalk. No temporary
signs place on the site shall be located in such a fashion which would
affect the site visibility of the motoring public as determined by
the Chief of Police or his designee.
U. The applicant shall submit with his application a
statement as to how the site shall be maintained during the designated
time period, as well as a statement indicating how trash, refuse and
other materials will be disposed of other than through normal solid
waste collection services provided by the Township of Waterford. All
debris, materials, trash, etc., must be removed from the site within
48 hours following the expiration of the seasonal license issued by
the Township of Waterford.
V. A certification from the Waterford Township Tax Collector
that all taxes have been paid and are current.
W. Proof of registration with the New Jersey Division
of Taxation and copy of a valid certificate of authority to collect
sales taxes.

A. Upon receipt of a properly completed and signed application, the
original application shall be referred immediately by the Township
Clerk to the Township Chief of Police who shall cause to be made within
30 days such investigation of the applicant's business and such
other factors as the Chief of Police deems necessary for the protection
of the public good and welfare.
B. Upon completion of the investigation, the Chief of Police shall endorse
thereon his/her approval or disapproval and, if disapproval, his/her
reasons therefor, and immediately notify the applicant that the application
has been disapproved, or if any of the applicant's employees/persons
to perform the service have been disapproved. The application, so
endorsed, shall be promptly returned to the Township Clerk.
C. Any determination by the Chief of Police that an application is unsatisfactory
or that any employees/persons listed on the application to provide
the service are unsatisfactory shall be based on one or more of the
following findings with respect to the applicant or any of the employees
of the applicant:
(1) Fraud, misrepresentation or false statements contained in the application.
(2) Fraud, misrepresentation or false statements made in the course of
carrying on the business of solicitor, vendor, peddler, or canvasser.
(3) Any violation of this chapter, past or present.
(4) Conviction of a crime or misdemeanor involving moral turpitude.
(5) Previous identified fraudulent acts or conduct.
(6) A public record of breaches of other municipality peddling, soliciting
or canvassing ordinances.
(7) Conducting the business of soliciting, peddling or canvassing in
an unlawful manner or in such a manner as to constitute a breach of
the peace or to constitute a menace to health, safety or general welfare
of the public.
D. An approved and endorsed business registration application shall
be returned to the Township Clerk by the Chief of Police and shall
include a Township-issued identification badge. The identification
badge shall include the name or names of all employees/persons to
work for the applicant and the expiration date of each license. Upon
payment of the prescribed registration fee, the prescribed license
fee and identification badge fee as hereinafter set forth, the Township
Clerk shall execute and deliver the licenses for each employee or
person who is to work for the applicant. The employees/persons performing
the service for the applicant shall be required to display the identification
badge at all times by wearing it on the outside of the licensee's
clothing in a conspicuous manner. The Township Clerk shall keep a
record of all licenses issued to all employees/persons working for
the applicant who has been issued the business registration certificate,
the fees received and any and all complaints made by Township residents
concerning the applicant and/or licensees.

Grounds for denial of licenses shall be as follows:
A. Failure to comply with application, procedures and requirements as set forth in §§
208-6 and §
208-7 of this article shall constitute a basis for denial of a license.
B. Revocation and/or denial of a license for good cause
by any municipality shall constitute a basis for denial of a license.
C. Violation of any grounds set forth in the §
208-13 of this article entitled "Revocation."
D. Disapproval by the Chief of Police after his review
as to matters relating to the health, safety and welfare of the Township
of Waterford.
E. Other good cause as set forth in the investigation
by the Chief of Police.

A. Business registration fee. Any application for peddler, hawker, vendor,
solicitor, canvasser or seasonal sales vendor shall be required to
pay a fee of $250 to the Township Clerk to cover the cost of processing
the application and to investigate the facts stated therein in order
for a registration certificate to be issued to the applicant.
B. License fee. A license fee of $75 shall be assessed for each employee/person
working for the applicant in the Township. The $75 fee for each license
to be issued to each employee/person is to cover the cost of completing
the investigation and background on each employee/person. Any applicant
for a seasonal sales vendor registration certificate and license shall
be required to pay a fee of $300 to the Township for the issuance
of the certificate/license.
C. The Township-issued identification badges. The fee for the Township identification badge for each person to be issued a license is $25 to cover the costs of processing and creating the badge, unless exempted by Subsection
B. In the event the identification badge is destroyed or lost, a replacement fee of $25 shall be assessed.

All business registration certificates issued as set forth in
this chapter shall expire at the end of six months from the date of
issuance of the certificate. All licenses issued to employees/persons
working for the applicant, no matter at what date issued, shall expire
at the same time as the business registration certificate. A business
registration certificate shall not be transferrable and must be surrendered
after expiration before a renewal business registration certificate
can be issued. The renewal process for business registration and licenses
is through the same procedure as for the issuance of the initial business
registration certification and licenses.
A seasonal sales license issued shall be for a period of time as set forth in §
208-3, entitled "Definitions," of this article. A separate license shall be applied for each seasonal sales activity, as well as employed by an organization (profit or nonprofit) and/or business. Licenses shall not be transferable and must be surrendered after expiration before a new license and/or registration can be issued for each seasonal sales activity. Any activities involving the sales of merchandise as defined under the definition of "Merchandise (Seasonal Sales)" in §
208-3 of this article shall be required to obtain a seasonal sales license notwithstanding the issuance of a vendor's license prior to the adoption of this article.
Licenses issued under this article may be revoked
by the Chief of Police or his designee after reasonable notice and
hearing for any of the following causes:
A. Misrepresentation or false statement contained in
the application for the license and registration of individuals engaged
by the organization (profit or nonprofit) and/or business.
B. Misrepresentation or false statement made in the cause
of carrying on activities regulated herein.
C. Conviction of any crime or disorderly persons offense
involving moral turpitude.
D. Conducting the business of soliciting, canvassing
vending, hawking or seasonal sales activities in an unlawful manner
and in violation of any provision of this article or in such a manner
as to constitute a breach of the peace or to constitute a menace to
health, safety or general welfare of the public.
E. Any violation of the provisions of this article shall
be cause for immediate revocation of a license issued by the Township
of Waterford, and the revocation of a license shall be grounds for
nonissuance of a license for a period not to exceed two years. Notice
of hearing for revocation of a license shall be given in writing,
setting forth the grounds of complaint and the time and place of hearing.
Such notice shall be served personally upon the licensee by means
of a summons, or by mail, postage prepaid, to the licensee at the
address given by the licensee in making application at least five
days prior to the date set for a hearing in accordance with the provisions
of this article. Hearing will be held within 30 days of issuance of
the notice of revocation.

Notwithstanding the right of revocation, reserved
to the Township governing body, and in addition to same, it shall
be the duty of any police officer or enforcement official of the Township
of Waterford to require any person peddling, soliciting, canvassing
or hawking and who is not known by such officer to be duly licensed,
to produce their peddler's license and/or to otherwise enforce
any of the provisions of this chapter against any person found to
be violating same.

Any licenses already issued under Chapter
208 of the Code of the Township of Waterford prior to the effective date of this amended chapter shall expire on December 31, 2017. Nothing herein shall be construed to limit or prohibit an existing applicant from reapplying for a business registration certificate and licenses under this chapter prior to that date.
Any person, organization (profit or nonprofit)
and/or person aggrieved by the actions of the Chief of Police and/or
the Township Clerk in the denial of an application for a license as
provided in this article, or in the decision with reference to the
revocation of a license as provided in this article, shall have the
right of appeal as set forth in this article.

Any person, firm or corporation who violates
any of the provisions of this article shall, upon conviction thereof,
be subject to a fine not more than $1,000 or be imprisoned for not
more than 90 days, or be subject to a period of community service
for up to 90 days, or any combination thereof. Each day that a violation
shall exist shall be construed as a separate offense.
A. This article shall not be so construed as to apply
to the selling of any item or article at wholesale to dealers in such
articles or items, or to the delivery of milk, eggs, bread, butter,
newspapers or to other articles or items of food or merchandise of
a type which are generally considered as household necessities and
that are commonly delivered on a house-to-house basis at intervals
of a week or less.
B. Any person honorably discharged from the United States
military or naval service as now defined in N.J.S.A. 45:24-9(a), or
as may hereafter be defined, shall be exempt from securing a license
or paying the fee as provided herein, but shall be required to comply
with all other applicable sections of this article, and shall be required
to register with the Township Clerk and obtain a special veteran's
permit which will be issued by the Township Clerk without charge upon
identification and exhibition of such state license.
C. Nonprofit groups.
(1) Any nonprofit religious, charitable, educational, political, civic or veterans organization, society, association or club desiring to sell any item or merchandise for a religious, charitable, patriotic, educational, civil or philanthropic purpose shall be exempt from the provisions of §§
208-3,
208-4,
208-6,
208-7,
208-10,
208-11 and
208-12 of this article, provided that there is filed a sworn application, in writing, with the Township Clerk, either by the individual so doing if done on an individual basis, or by the one in charge thereof if being done on a group basis by numerous individuals as agents or employees, who shall give the following information:
(a)
The name of the individual or organization and
purpose of the cause for which the permit is sought.
(b)
The names and addresses of the individual officers
and directors or trustees of the organization and the address of such
organization.
(c)
The location or locations of the property to
be utilized in conducting sales activity, if applicable.
(d)
The length of time anticipated to conduct the
activity.
(e)
Proof of permission to use the property or locations.
(f)
A sketch plan of the site where the activity
is to be conducted in order for the Township to determine the safety
of the location.
(g)
Compliance with §
208-7, Subsections
N through
T, on use of temporary signs.
(h)
A statement that the site will be maintained
properly during the activity and that any trash and/or refuse will
be removed and properly disposed within 48 hours following use of
the site.
(2) Upon satisfying the application requirements and upon
being satisfied that such person is a bona fide representative of
such an organization or that such organization, as aforesaid, is bona
fide, and that the agents or representatives who shall conduct the
transactions are approved representatives, the Township Clerk shall
issue a permit without charge to such organization, association or
corporation to operate in the Township. Such organization shall supply
its agents, representatives or employees with a badge or ribbon containing
the name of such organization, which shall be worn and conspicuously
displayed on the front of the clothing of such agent, representative
or employee.

A. The Township hereby establishes a Do Not Knock Registry. The Township
Clerk shall prepare a list of addresses of those premises where the
owner and/or occupant of same has notified the Township Clerk that
peddling, soliciting, canvassing, hawking and door-to-door sales as
identified in this chapter are not permitted on the premises. Any
property owner or occupant that wants to be included on the Do Not
Knock Registry shall complete a form that will be available at the
Township Clerk's office during normal business hours.
B. Do Not Knock Registry display.
(1)
Any owner and/or occupant who has requested to be identified
on the Do Not Knock Registry shall be provided a sticker from the
Township Clerk's office for prominent posting or display at their
premises indicating it is part of the Do Not Knock Registry, and peddling
or soliciting of any type is not permitted at the premises.
(2)
Owners and/or occupants who are identified on the Do Not Knock
Registry at their request shall remain on the registry until such
time as written notice is provided to the Township Clerk to remove
their name from the registry.
C. Distribution of Do Not Knock Registry. The Township Clerk shall provide
and distribute the current Do Not Knock Registry to any licensee under
this chapter at the time of issuing a license for peddling, soliciting,
canvassing, hawking or any other type door-to-door selling permitted
pursuant to the provisions of this chapter. The Do Not Knock Registry
provided to these licensees shall only identify the physical address
of the premises/properties on the Do Not Knock Registry. The licensee
shall not peddle, solicit, canvass, hawk or conduct door-to-door sales
at these premises identified on this registry.
