As used in this article, the following terms shall have the
meanings indicated:
A use, occupation or profession, including but not limited
to doctors, dentists, veterinarians, laboratories and retail or commercial
businesses, which is customarily carried on in a residential premises,
that generates medical waste, hazardous waste or waste other than
household putrescibles generated on or off residential premises.
Any person authorized to act in behalf of the owner of any
real property, whether residential, commercial, industrial or a combination
thereof, and shall include but shall not be limited to managing agents
and a mortgagee, whether or not in possession.
Shall not be placed out for collection, but rather, shall be disposed of in some other safe and appropriate manner. Prohibited waste shall include waste which from time to time be so classified by the superintendent of operations. This shall include but not be limited to the following: all recyclable materials as defined in Chapter 141 of this Code, all hazardous waste materials, all medical waste, stone, brick, concrete, asphalt, construction debris from home addition or major renovation projects requiring building permits and waste from commercial projects and/or properties.
All materials designated by the municipality to be source-separated from the solid waste stream for the purpose of recycling as contained in Chapter 141, Recycling. Pursuant to N.J.A.C. 7:26-1.4, recyclable materials means materials which would otherwise become nonhazardous solid waste which can be separated, collected and processed and returned to the economic mainstream in the form of raw materials or products.
Includes all Township single-family dwellings, multifamily
dwellings and/or high-rise apartment units, condominium units, townhouses
and cooperatives.
Includes non-prohibited waste generated within a residential
dwelling.

A.
The
owner, tenant or occupant or agent of the owner, tenant or occupant
of any residential premises shall cause to be removed from the premises
at a minimum of at least once weekly all solid waste, except during
June, July and August when solid waste will be collected twice weekly.
B.
All
residential premises utilizing dumpsters for disposal of solid waste
shall cause to be removed from the premises twice weekly all solid
waste.
C.
All
household bulk items shall be collected on the first and second solid
waste collection days of each month.

A.
All solid waste shall be kept in watertight metal or plastic receptacles
not to exceed 30 gallons in capacity with tightly fitted covers.
B.
All solid waste receptacles shall be kept clean and in good repair.
C.
Household bulk items, for the purpose of collection monthly, must
be stored on residential premises in such manner as not to create
a nuisance.
D.
All receptacles containing solid waste or recyclables shall be placed at the curb for collection no earlier than the day preceding the scheduled collection date and shall be removed the day of collection, and such receptacles shall be stored in an inconspicuous and sanitary location. Any person violating this section shall on the first violation be issued a written warning and for a subsequent violation shall be subject to a penalty, upon conviction, as stated in Chapter 1, Section 1-15.
E.
Residents involved in the renovation of said premises or moving out
of said premises are responsible for the removal of all solid waste
not collected by hauler.
Multi-dwelling units utilizing dumpsters for the collection
of solid waste shall be provided for multi-dwelling units. Dumpsters
must be fully waterproofed, have tightly fitting plastic lids and,
after emptying, be cleaned and sanitized as needed by the management
association of said multi-dwelling.
Compaction systems may be utilized with the approval from the
Health Officer for commercial establishments and from the Superintendent
of Operations for residential and multi-dwelling units.

A.
Dumpster
receptacles provided for multi-dwelling units and/or high-rise apartments
shall be stored in enclosures approved by the Township. The location
of such enclosures shall be convenient to all residents, and the location
thereof shall be approved by the Superintendent of Recycling and Solid
Waste.
B.
If
a compaction-type system is utilized, the compaction unit shall be
stored in an enclosure approved by the Township, easily accessible
to all residents.

A.
No person shall park or leave unattended any waste or refuse container,
commonly known as a roll-off dumpster or roll-off container, on or
along any municipal roadway or municipal property, without a permit
issued by the Construction Official. Consent shall be valid and remain
in effect for a period of not more than 30 days.
B.
Any roll-off dumpster or roll-off container parked on or along any
roadway shall be equipped with and display markers consisting of all
reflective diamond-shaped panels having a minimum size of 18 inches
by 18 inches to warn the operators of vehicles of the presence of
a traffic hazard requiring the exercise of due caution. These panels
shall be mounted at the edge of the dumpster or container, at both
ends, nearest the path of passing vehicles and facing the direction
of oncoming traffic. These markers shall have a minimum mounting height
of three feet from the bottom of the panels to the surface of the
roadway. Reflective taped traffic cones shall be placed around the
perimeter of the container while in the public right-of-way.
C.
Any person who places a roll-off dumpster or container within a public
right-of-way shall first pay an application fee of $125 and furnish
the Township with proof of liability insurance in the amount of not
less than $500,000. Applications will be available in the Building
Department.
D.
The Construction Official and the Chief of Police or designee shall
investigate to determine if the request is warranted and, if so that
a site condition can exist. Upon review and approval, the Construction
Official shall issue a permit for the location and time period.

A.
It shall be unlawful to place upon any property within the Township
a roll-off dumpster or container without having first obtained a permit
from the Construction Official. Roll-off dumpsters or containers associated
with an active construction permit need not obtain a separate permit
but are subject to the provisions set forth in this section.
B.
No roll-off dumpster or container shall be allowed for a period exceeding 48 hours unless associated with an active construction permit as set forth above in § 83-11A. Extensions may be granted at the sole discretion of the Construction Official. No more than two extensions shall be granted within any six-month period.
C.
No roll-off dumpster or container shall be located within 10 feet
of any property line unless it is located completely within a paved
driveway.

Any person or persons who shall violate or fail to comply with
any of the provisions of this article, upon conviction thereof, shall
be punished by a fine of not less than $500 and not exceeding $10,000.
Each day that a violation exists shall constitute a separate violation.
