Except as provided in this chapter or in any other provisions of the Code of the Township of Wayne, it shall be unlawful to construct or maintain any privy, privy vault or individual sewage disposal system.
Where a public or private sanitary sewer system is not available under the provisions of § 159-5, the house service connection shall be connected to an individual sewage disposal system complying with the provisions of Chapter 157, Sewage Disposal Systems, Individual.
Before the commencement of construction of an individual sewage disposal system, the owner shall obtain a written permit from the Department of Health as provided in Chapter 157.
The type, capacity, location, design and layout of an individual sewage disposal system shall comply with all requirements of Chapter 157.
Inspection and approval by the Health Officer of an individual sewage disposal system shall be in accordance with the provisions and requirements of § 157-13 of Chapter 157.
When a public or private sewer system becomes available to a property served by an individual sewage disposal system, a direct connection shall be made to the public or private sewer system in compliance with this chapter. Such individual sewage disposal system shall then be forthwith abandoned and filled with suitable material within a period of 180 days following receipt of written notice to that effect from the Division of Engineering, given to the property owner; provided, however, that the above-stated period may be extended by the Mayor upon a finding after investigation thereof that such connection shall constitute an undue hardship and shall be unreasonable in accordance with the facts then applicable to any individual.
The property owner shall operate and maintain the individual sewage disposal system in a sanitary manner at all times.
This article shall not be construed to prevent the imposition of additional requirements by the Health Officer, the Department of Health or by any other body having jurisdiction.
