The owner/developer of a residential development shall, within
six hours of the end of the snowfall or the ice being formed thereon,
remove or cause to be removed snow and ice from the unaccepted dedicated
streets within the development. The snow and ice shall be removed
so that an unobstructed portion of the travel area of the unaccepted
dedicated street is open to a width of at least 25 feet. Should the
snowfall accumulation exceed six inches in depth prior to the end
of the snowfall, the owner/developer must remove snow and continue
to remove snow on a regular basis as required, so that at no time
the snow accumulation exceeds six inches in depth within the prescribed
25 foot width.
In cases where the owner/developer of a residential development has failed or, after receipt of notice from the Township Engineer or Director of Public Works or has refused to remove snow and/or ice from the unaccepted dedicated streets within the development, the Township shall remove or cause the same to be removed. In addition, the Township Engineer, Director of Public Works or any Police Officer may issue a notice of violation or summons to the owner/developer for a violation of this chapter. The Township shall be reimbursed for the cost of the removal in accordance with §
180-37. Notice for purposes of this section shall be by any appropriate means of communication addressed to the owner/developer, his/her agents, servants and/or employees, including but not limited to hand delivery, mail, telephone, telegram, facsimile, or electronic mail.
The Township Engineer or Director of Public Works shall certify the cost of removal of snow and/or ice from the unaccepted dedicated streets in a residential development performed in accordance with §
180-36. In addition to the cost of removal, a charge of 15% of the total cost shall be imposed as an administrative charge. The Township shall submit the invoice to the owner/developer who shall, within 30 days of the date of said invoice, pay the invoice in full. If any portion of the invoice for the cost of removal of the snow and ice remains unpaid after 30 days from the date of the invoice, the Chief Financial Officer shall withdraw from the Interim maintenance escrow account established pursuant to Chapter
134 of the Township Code the unpaid amount of the invoice.
Any person who violates any provision of this article shall, be liable upon conviction, to the penalties stated in Chapter
1, Section
1-15.
