No license shall be required to do minor repair work, such as repairing
and replacing lamp sockets and receptacles, repairing appliance and lamp cords,
and replacing burnt-out fuses; and no license shall be required for any person
engaged in electrical work of any nature who is employed exclusively by one
person, firm or corporation, provided that said person confines his electrical
work to and about the premises of the firm, person or corporation by whom
he is employed regularly.
No person shall enter into, engage in or work at the businesses of installing
wires, conduits, apparatus, fixtures or other appliances carrying or using
electricity for light, heat or power purposes, either as master electrician
or journeyman, unless such person shall have received a license and a certificate
of competency therefor issued by the Electrical Examining Board and in accordance
with the provisions hereinafter set forth.
A.
Journeyman. Any person desiring or intending to engage
in the occupation of journeyman within the Village shall be required to submit
to the Electrical Examining Board a statement under oath of his name, age,
occupation and general experience, together with a statement showing by whom
he was engaged for five years prior to the date of application and the nature
of the services performed.
B.
Master electrician. Any person desiring or intending
to engage in the business of master electrician within the Village shall be
required to submit to the Electrical Examining Board a statement under oath
of the name, location and owners and officers of the individual, firm or corporation
seeking such license and a statement of the particular nature of the business
to be conducted.
It shall be unlawful for the applicant to make any false or misleading
statements in the written application for a license issued hereunder, and
any person who shall make a false or untrue statement in such application
for the license herein provided for shall be held to have violated the provisions
of this article.
All applications for licenses issued under the provisions of this article
shall be made on forms supplied by the Electrical Examining Board and shall
be filed with the Building Inspector of the Village.
After a license application has been filed with the Building Inspector as provided in § 125-18, said Building Inspector shall notify Electrical Examining Board of the filing of the application for the license, and the Board shall thereupon determine the fitness of the applicant upon such written application or upon oral examination of the applicant, as to the facts set forth in the written application.
The examination provided for in § 125-19 shall not be required of any person who shall have been duly licensed as a master electrician or journeyman under any ordinance, either in the Village or elsewhere, at any time during a period of two years immediately preceding the application for the licenses provided for herein and who shall, upon proof thereof to the satisfaction of the Electrical Examining Board, be deemed fit and qualified to receive a license.
If, upon examination of an applicant for a license issued under the
provisions of this article, a majority of the Electrical Examining shall be
satisfied of the fitness and competency of such applicant to engage in the
business of master electrician or the occupation of journeyman, said Board
shall issue to the applicant a certificate of competency and shall authorize
the issuance of the original license.
Three types of licenses shall be issued under the provisions of this
article. The first, hereinafter referred to as "License A," shall known as
the "master electrician's license"; the second, hereinafter referred
to as "License B," shall be known as the "journeyman license"; and the third,
hereinafter referred to as "License C," shall be known as a "limited license."
The obtaining and holding of one type of license shall not disqualify the
holder from obtaining the other types of licenses.
A.
Generally. License A shall be issued to any person engaged in, or to engage in, the business of installing electrical wires, conduits, apparatus, fixtures and other appliances. The issuance of License A shall not entitle the holder individually to engage in or perform the actual work of installing electrical wire, conduits and appliances as described in this chapter, unless licensed as a journeyman, but shall entitle such holder to conduct a business as a master electrician. The holder of License A shall employ licensed journeymen except as otherwise provided in § 125-35 of this article.
B.
Filing of certificate of competency; fee and issuance
of license. A certificate of competency granted to an applicant for a master
electrician's license shall be filed with the Village Clerk, and, upon
the payment to said Village Clerk of the sum of $100, a license shall be issued
to the person in accordance with said certificate.
A.
Generally. A certificate of competency issued to a journeyman
by the Electrical Examining Board shall entitle the holder thereof to obtain
and hold License B. The issuance of License B shall entitle the holder individually
to engage in and perform the actual work of installing electrical wires, conduits
and appliances as described in this chapter but shall not entitle the holder
individually to engage in the business of installing electrical wires, conduits
and other appliances unless licensed as a master electrician.
B.
Filing of certificate of competency; fee and issuance
of license. A certificate of competency issued to a journeyman shall be filed
with the Village Clerk, and, upon payment to said Clerk of the sum of $25,
a license shall be issued to the person to whom said certificate of competency
was issued, in accordance with said certificate.
A.
Generally. A License C limited license shall authorize
the licensee to install signs, compressors, air-conditioning units, dryers,
heating and refrigeration and all other electrically controlled or operated
equipment. No electrical wiring is to be done by the holders of License C
except to the point of power.
B.
Filing of certificate of competency; fee and issuance
of license. A certificate of competency issued to an applicant for a License
C or limited license shall be filed with the Village Clerk, and, upon payment
to said Clerk of the sum of $10, a license shall be issued to the person to
whom said certificate was issued and in accordance with said certificate.
A.
Generally. A license D shall be a temporary, single-use license for qualified master electricians from outside the surrounding area to be used to perform a single job within the Village of Endicott. License D shall be issued to any person engaged in, or to engage in, the business of installing electrical wires, conduits, apparatus, fixtures and other appliances. The issuance of License D shall not entitle the holder individually to engage in or perform the actual work of installing electrical wire, conduits and appliances as described in this chapter, unless licensed as a journeyman, but shall entitle such holder to conduct a business as a master electrician. The holder of License A shall employ licensed journeymen except as otherwise provided in § 125-35 of this article.
B.
Filing of certificate of competency; fee and issuance
of license. A certificate of competency issued to an applicant for a License
D or limited license shall be filed with the Village Clerk, and, upon payment
to said Clerk of the sum of $500, a license shall be issued to the person
to whom said certificate was issued and in accordance with said certificate.
All licenses issued under the provisions of this article shall be signed
by the Village Clerk.
A.
Any license issued pursuant to this article shall expire
on the 30th day of April after the date of issuance. Such license, however,
may be renewed from year to year without further examination upon payment
to the Village Clerk of the same fee payable upon issuance of the original
license.
B.
Failure to renew license. Any licensed master (License
A) or journeyman (License B) who fails to renew his/her license prior to the
expiration thereof shall pay an additional fee of $5 for each year or part
thereof, together with the current license fee prescribed in this chapter.
Prior to issuance of a license, the applicant must bring his/her license current
for all back years.
The Electrical Examining Board may revoke or suspend the license of
any person for violation of any of the provisions of this chapter upon notice
to him and after a hearing conducted as prescribed by the published rules
of said Board.
In the event that the Electrical Examining Board shall suspend or revoke
the license of any person who has obtained a license pursuant the provisions
of this article, such person shall have the right to appeal such suspension
or revocation to the Mayor and Board of Trustees.
Any person to whom a license has been issued hereunder and whose license
has been revoked cannot make an application for reissuance of his license
for a period of not less than one year from the date of such revocation.
The provisions of this chapter shall not prohibit the owners of owner-occupied,
single-family residences from securing electrical permits for work to be performed
solely by the owner. Work is limited to wiring, outlets, switches and lighting
in the dwelling and accessory structures, performed on the load side of the
electrical panel, and is subject to the same standards and inspection as all
other electrical work performed in the Village. Specifically excluded work
includes service entrance cable and electrical panel.
A.
Required. Before beginning any electrical work, a master
electrician shall apply for and receive a permit for each installation subject
to the rules and regulations of the Electrical Examining Board.
B.
Display. Such permit for electrical work shall be displayed
on the premises where the work is done until removed by the Electrical Inspector,
his/her designee or successor.
C.
There shall be a fee of $10 for permits for electrical
work.
D.
All electrical work requiring a permit must be inspected
by the Electrical Inspector, his/her designee or successor.
Any person engaging in electrical installations for which a permit has
been issued in the Village shall be in the actual employment of the contractor
or master electrician to whom the permit has been issued, and said contractor
or master electrician shall assume all responsibility as to the proper installation
and any violation of the provisions of this chapter.
This article shall not forbid or prevent the employment of helpers or
apprentices working with and under the direct personal supervision of a licensed
journeyman; except, however, that no licensed journeyman shall have more than
two helpers or apprentices.
Any person violating any of the provisions of this chapter shall be
guilty of a violation and, upon conviction thereof, shall be punishable by
a fine not exceeding $250 for each offense or imprisonment not exceeding 15
days, or both such fine and imprisonment. Any property owner knowingly violating
any section of this chapter or knowingly hiring a person to perform work covered
by this chapter, who is not licensed pursuant to this chapter, shall be guilty
of a violation and, upon conviction thereof, shall be punishable by a fine
not exceeding $250 for each offense or imprisonment not exceeding 15 days,
or both such fine and imprisonment.
