It shall be unlawful for any person, firm or corporation to permit the
emission of any dense smoke from any source whatever longer than two minutes
and greater in density than described as No. 1 on the Ringelmann Chart, published
by the United States Bureau of Mines.
It shall be unlawful for any person, firm or corporation to permit the
escape of such quantities of soot, cinders, noxious acids, fumes and gases
in such places or manner as to be detrimental to any person or to the public
or to endanger the health, comfort or safety of any such person or of the
public or in such a manner as to cause or have a tendency to cause injury
or damage to property or business.
No new fuel-burning plant nor reconstruction, repair, addition or alteration
to any existing fuel-burning plant for producing power or heat or either of
them, or refuse-burning equipment nor any stack or furnace connected with
such refuse-burning equipment, shall be installed, erected, reconstructed,
repaired, added to or altered until plans and specifications of the same have
been filed by the owner or contractor with the office of the building official
of the Village of Rockville Centre and a permit issued by such office.
Privately owned incinerators shall be operated and maintained in accordance
with the following regulations:
A. Incinerators shall be operated only between the hours
of 7:00 a.m. and 5:00 p.m.
B. Before lighting, enough material must be removed to clear
the flue; also, all smoke-producing material such as linoleum, paint cans,
oily rags, plastic and leather goods must be removed.
C. All incinerators must be lighted from the top of the
pile.
D. If the incinerator has a gas burner, it must be burning
when the incinerator is in use.
E. All doors must be closed and air slide adjusted to avoid
too much draft up the stack. Fire must be kept hot, but not roaring or noisy.
F. The contents of the firebox must not be disturbed while
a hot fire is burning.
G. Materials must not be dropped in the incinerator while
there is an active fire.
H. Incinerator chimney must be inspected by the operator
while incinerator is burning. If smoke odors or fly ash are being emitted,
proper adjustments must be made.
I. All incinerator fire must be extinguished before 5:00
p.m. and ashes removed from the firebox.
J. The secondary combustion and the settling chamber must
be cleaned at least twice a week and when the incinerator is cold.
K. Overloading of refuse within the firebox shall be prohibited.
For any and every violation of the provisions of this chapter, the owner, general agent or contractor of a building or premises where such violations have been committed or shall exist, and the lessee or tenant of an entire building or entire premises where such violation has been committed or shall exist, and the owner, general agent, contractor, lessee or tenant of any part of the building or premises in which part such violation has been committed or shall exist, and the general agent, architect, builder, contractor or any other person who knowingly commits, takes part or assists in any such violation or who maintains any building or premises in which any such violation exists, shall be subject to the penalties specified in §
1-2 of the Code of the Village of Rockville Centre.
