[HISTORY: Adopted by the Board of Trustees
of the Village of Thomaston 8-16-1993 by L.L. No. 3-1993 (Ch. 19 of
the 1980 Code). Amendments noted where applicable.]
A. Section 3-300, Subdivision 2, of the Village Law of
the State of New York is hereby repealed in its application to the
Village of Thomaston.
B. Except as otherwise provided in this section, no person
shall be eligible to be appointed to or to hold any appointed village
office unless such person is a citizen of the United States; is at
least 18 years of age; is a resident of the Village of Thomaston;
and, if eligibility to or holding of such office is subject to regulation
under the Civil Service Law of the State of New York or any other
law, meets the requirements of such law or laws.
C. Notwithstanding the provisions of Subsection
B hereof, with the consent of the Board of Trustees, the Village Clerk-Treasurer and the Deputy Village Clerk-Treasurer need not be residents of the Village of Thomaston, but must be residents of the County of Nassau or a county adjoining Nassau County.
D. Notwithstanding the provisions of Subsection
B hereof, inspectors of election at Village elections need not be residents of the Village of Thomaston but must be residents of the County of Nassau.

A. Subdivisions 3 and 4 of § 3-302 of the Village
Law of the State of New York are hereby repealed in their application
to the Village of Thomaston.
B. The elected officers of the Village of Thomaston shall
be one Mayor and four Trustees, and the term of office of the Mayor
and each Trustee shall be two official years. Except as otherwise
provided by law, the term of office of every other Village officer
shall be indefinite, and such persons shall serve at the pleasure
of the Mayor; provided, however, that any officer permanently appointed
to an office classified in the competitive class of the civil service
shall hold such office for an indeterminate term subject to the provisions
of the Civil Service Law.

A. Section 3-301(1)(c) of the Village Law of the State
of New York is hereby amended in its application to the Village of
Thomaston, to read as follows: "c. a clerk, or a village administrator."
B. Section 3-301(1)(d) of the Village Law of the State
of New York is hereby amended in its application to the Village of
Thomaston, to read as follows: "d. a treasurer, except where the village
has elected to have a village administrator, in which case the power
and authority of the treasurer shall be vested in the administrator."
C. The Board of Trustees may from time to time establish
or abolish the office of Village Administrator, in lieu of the offices
of Village Clerk and Village Treasurer.
D. The Village Administrator shall have the powers and
duties of the Village Clerk and the Village Treasurer, as may be provided
in the Village Law or any other statute, law, rule or regulation of
the State of New York or as may be provided by this Code. Any reference
in any statute, law, rule or regulation or Code to the Village Clerk,
Treasurer, or Clerk-Treasurer shall be deemed to be a reference to
the Village Administrator. The Village Administrator also shall have
such other powers and duties as may be designated or assigned from
time to time by the Mayor, with the consent of the Board of Trustees,
in the manner authorized by law, including the functions of one or
more other positions duly authorized by law.
E. Where the Board of Trustees has authorized the position
of Village Administrator, the Village Administrator shall be appointed
by the Mayor, subject to the approval of the Board of Trustees, to
serve at the pleasure of the Mayor. Notwithstanding any other provision
of law to the contrary, with the consent of the Board of Trustees,
the Village Administrator shall not be required to be a resident of
the Village of Thomaston, but shall be a resident of the County of
Nassau or a county which adjoins the County of Nassau.
F. Section 3-302(3) and (4) of the Village Law of the
State of New York are hereby expressly superseded by this section,
to the extent that any provisions of the Village Law may be inconsistent
with the provisions of this section.

A. Legislative intent. It is the intent of the Board
of Trustees of the Village of Thomaston to abolish and terminate the
Village of Thomaston Village Justice Court and the positions of Village
Justice and Acting Village Justice, and the support system for such
court, pursuant to the Board's authority granted by Village Law §§
3-301, 3-302 and 3-303. Accordingly, the Village Justice Court of
the Village of Thomaston would cease to exist, and the positions of
Village Justice, Acting Village Justice, Village Court Clerk and all
supportive services for the Village Justice Court would terminate.
B. Abolition of positions.
(1) The position of Village Justice of the Village of
Thomaston is hereby abolished.
(2) The position of Acting Village Justice of the Village
of Thomaston is hereby abolished.
(3) The position of Village Justice Court Clerk in the
Village of Thomaston is hereby abolished.
(4) The position of Village Justice Court Clerk, part-time,
in the Village of Thomaston is hereby abolished.
C. Transfer of cases to Nassau County District Court.
Upon the effective date of this legislation, all matters then pending
or returnable in, and all proceedings with respect to any matters
previously within the jurisdiction of, the Village Justice Court of
the Village of Thomaston shall be transferred to, and heard and determined
in, the Nassau County District Court.
