All electrical installations, alterations and maintenance of wiring
for electric light, heat or power, and signal systems operating on fifty (50)
volts or more, in or on all real property within the Village of Thomaston
shall be made in conformity with the requirements of the National Electrical
Code, as a minimum standard, except where the provisions of this chapter or
any other local law, ordinance or code of the Village of Thomaston shall differently
prescribe, in which event compliance with the provisions of such local law,
ordinance or code shall be recognized as proper compliance with this chapter.
The requirements of the National Electrical Code shall be those known as "National
Fire Protection Association Pamphlet No. 70," as approved and adopted by the
American National Standards Institute.

The Board of Trustees may, in its discretion, appoint one (1) or more
Electrical Inspectors for the purposes of this chapter, each of whom is authorized
to make such inspections and reinspections of electrical installations as
described in this chapter and to approve or disapprove such installations.
The cost of any such inspection shall be paid by the applicant for such approval,
if any, and shall not be a charge against the village except where such inspection
is ordered by the village.
It shall be the duty of each said Electrical Inspector
to report, in writing, to the Village Building Inspector all violations of,
deviations from or omissions of the electrical provisions of the National
Electrical Code insofar as any of the same apply to electrical wiring in the
Village of Thomaston.

Upon the presentation of identification credentials issued by the village
to any Electrical Inspector appointed pursuant to this chapter, no owner or
person in possession of any premises in the Village of Thomaston shall refuse
to permit an inspection to be made by such Electrical Inspector.
In the event of an emergency, it is the duty of the Electrical Inspectors
to make electrical inspections upon the request of the Village Building Inspector.
It shall be the duty of each said Electrical Inspector to furnish a
written report to the Village Building Inspector and the owners or persons
in possession of the property where violations of this chapter are found to
exist. Where such Inspector fails to make reports of violations after inspections,
his or her approval as an Electrical Inspector may be withdrawn by the Village
Building Inspector.
Where any certificate of compliance is issued pursuant to this chapter,
a copy of such certificate shall be forwarded to the Village Building Inspector.
The provisions of this chapter shall not apply to the electrical installations
in railway cars, to automotive equipment or to installations or equipment
employed by a railway, electrical or communication utility in the exercise
of its function as a utility and located outdoors or in buildings used exclusively
for that purpose nor to any work involved in the manufacture, assembly, test
or repair of electrical machinery, apparatus, materials and equipment by a
person, firm or corporation engaged in electrical manufacturing as his, her
or its principal business, nor to any building which is owned or leased in
its entirety by the government of the United States or the State of New York.
Nothing contained in this chapter shall preclude the installation of replacement
parts in existing oil or gas burners, heating systems or air conditioners
by the owners of one-family homes.

This chapter shall not be construed to relieve from or lessen the responsibility
of any person owning, operating, controlling or installing any electrical
wiring, device, appliance or equipment for loss of life or damage or injury
to any person or property caused by any defect therein, nor shall the Village
of Thomaston or any of its Electrical Inspectors designated pursuant to this
chapter be deemed to have assumed such liability by reason of any act or omission
pursuant to this chapter.
No person, firm or corporation, including the owner, tenant or occupant
of the premises concerned and his or her servants, employees and agents, shall
alter, add to or perform any work in relation to the electrical system, wiring,
equipment or installations of any building or structure in the Village of
Thomaston, regardless of whether a permit for the work has been applied for,
issued or required, unless he or she holds, unsuspended and unrevoked, an
electrician's license issued by the Town of North Hempstead. The licensee
shall keep the license in his or her possession at all times while performing
any such work in the village and shall exhibit it to the Building Inspector
or any other representative of the village forthwith upon request. The failure
of any person to exhibit such a license on demand as required under this chapter
shall be presumptive evidence that such person does not hold such a license.

A.
No person, firm or entity may install or cause to be
installed or alter or cause to be altered any electrical installation or wiring
for heat, light or power in or on a property in the Village of Thomaston until
an application for inspection of such installation or wiring has been filed
with the Village Electrical Inspector.
B.
No person, firm or entity may connect electrical wiring
or cause such wiring to be connected in or on any property in the Village
of Thomaston for light, heat or power to any source of electrical energy supply
prior to the issuance by the Electrical Inspector of a certificate or temporary
certificate of compliance.
A.
Any person, firm or corporation who shall violate any provision of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article II, of this Code establishing penalty provisions applicable to offenses generally against the ordinances and local laws of the village.[1]
